it was my bad loto i didn't read it clearly and if he wants to do it that way then ok. i have seen it done also that way too. but a few people were talking about head of household and things like that.

did we just get two approvals today. how many more is needed to coomplete march? realistically?

i see that vermont is working on k-1's for july now. theya re just cruising right along but csc is working on may 2010. and we are still waiting for march.

i did read something tonight i thought was interesting. i would think filing a tax return with your wife would be a good thing. i guess it would show proof of marriage also. last year i was able to file with my wife because she was here. i never thought about it before tonight.

Hey all,

I called IRS and explained that wife was not in the country and when the accountant was filing taxes he filed as single although I was married September of last year. He did it so that whenever she gets here, we can file jointly. IRS said it was a wrong move because I am married and cannot file single. They suggested I first of all fill a W-7 and have wife sign it and then file a 1040X (amended tax form) and file as married filing jointly.

First of all, establishes we are married and I am sure it will boost my refund by a bit (praise the Lord). I am waiting for her signed w-7 to arrive along with a notarized copy of the biographical page of her passport and send it along with the amended tax to Texas. I am told the process should take about 6 weeks.

I believe this csan be good (ITIN) as it shows further proof that we are truly married. How I wish I knew about this before filing my taxes in January.

Rich and Bey, it is perfectly fine. Whenever the debate happens, we all dig for more details and conclude for the accurate solution. Debates are part of the public forum, so there is nothing wrong in it as long as it is healthy conversation and all participants learn something new and useful out of it. Everybody including me makes mistakes. I am sorry if I hurt your feelings in any way!

agynyame, yes, as Rich and Bey mentioned, the joint tax filing would make the bona fides of one's marriage much stronger. At the interview time, even when my wife took the photos, chat history, entire album etc., CO didn't even look at those. We had marriage certificate, 2 affidavits from third parties, joint tax filing transcripts etc. This time to make the family relationship even stronger, we have our new born's birth certificate as well.

Of course, other benefit, as you told, have more refund in your pocket and squeeze the max. out of Uncle Sam's pocket :-)

Most definitely although I got angry at my accountant for not knowing that and csusing a blunder that could have been problematic for me. I hope the amended tax will be done before NOA2 otherwise it will mean more waiting in order to turn in I864ez.

Regarding taxes you can file as married and claim her as dependent even if she has not ITIN or SSN. You will need to get form W-7 filled out, write a short note, attach copy of certified ID, i.e Passport etc and send it all in together. You will not be able to file electronically. On your 1040 for her SS# you leave it blank.

If you want to be certain, do a search on google about what I just said. Prepare your taxes and then take to the nearest IRS office and file it in person. They will accept it with their stamp and then you can send it in.

Its actually a good thing, down the road during the NVC process you can show that you been filing taxes as married with your spouse. I went this way this year, I was married last year Dec 28, so hopefully I won't have any issues.

One files IRS Form W-7 to obtain an ITIN. Using ITIN, you can include your spouse on your tax return. Without an ITIN or SSN, you cannot include a person on your tax return. IRS and SSN are two different agencies. They don't share information. ITIN is an internal ID used only by IRS. If you obtain an ITIN for your spouse before she has immigrated to US, you can still obtain a SSN once she gets here (as you would normally.)
