You can get ITIN later and amend your past return if you want.

When I did my taxes in 2007, I applied her ITIN along with the tax forms. It processed and accepted the return. We were married in Nov 2007 and she was here in Green Card & SSN in Jul 2008.

Ture, or I could wait for her to get here and just do the amendment after she is here and she will have a SSN by then. So no need to apply for the ITIN

please do not give out bad information. first off you apply for an itin if you never plan on getting a social security number. you should go for the social security number if you are married. my wife has her social security number since before we were married. an itin is for people that are really illegal and want to file taxes. remember you file your taxes based on what you are as of december 31st. but if the wife doesn't ahve a social security number and gets one the next year then you can go back and amend the return but if she doesn't live there for the last 6 months of the year then you can do head of household if you have a child or a parent.

Regarding taxes you can file as married and claim her as dependent even if she has not ITIN or SSN. You will need to get form W-7 filled out, write a short note, attach copy of certified ID, i.e Passport etc and send it all in together. You will not be able to file electronically. On your 1040 for her SS# you leave it blank.

If you want to be certain, do a search on google about what I just said. Prepare your taxes and then take to the nearest IRS office and file it in person. They will accept it with their stamp and then you can send it in.

Its actually a good thing, down the road during the NVC process you can show that you been filing taxes as married with your spouse. I went this way this year, I was married last year Dec 28, so hopefully I won't have any issues.

anthony i am an accountant so if you need to know anything i can answer i will try and help.

What I just wrote about applying with W-7 along with 1040, where the IRS assigns a temp number in their database for processing sake, is that incorrect ? I went to the IRS office and they seem to accept it, even though I told them my wife is overseas and does not live in the US

I think just to be safe I will wait until my wife is here and then file my 2010 taxes with her. Just so I don't have to deal with the hassle. And besides even if I amend my taxes from last year it would not make a big difference. I still owe the IRS money.

ITIN is not just for illegal peoples........it is more like those who are on legal status but unable to obtain SSN. Such as a spouse of H1-B on a dependent visa.

look an itin is used for people that are primarily illegal and can not get social security numbers. if you read the form it says if you do not plan to get a social security number than you can get an itin. but an itin is a way for the IRS to keep track of people. they are usually illegal that will not get a social security number so if your wife is coming here than you wait for the social security number and not the itin. it just confuses things if you get both. i had that problem with someone this year with their tax return. they had both and it was filed under the itin and it caused all kinds of problems and weeks for the IRS to straighten out. this is from the IRS website...

What is an ITIN?

An Individual Taxpayer Identification Number (ITIN) is a tax processing number issued by the Internal Revenue Service. It is a nine-digit number that always begins with the number 9 and has a range of 70-88 in the fourth and fifth digit, example 9XX-70-XXXX.

IRS issues ITINs to individuals who are required to have a U.S. taxpayer identification number but who do not have, and are not eligible to obtain a Social Security Number (SSN) from the Social Security Administration (SSA).

ITINs are issued regardless of immigration status because both resident and nonresident aliens may have a U.S. filing or reporting requirement under the Internal Revenue Code.

Individuals must have a filing requirement and file a valid federal income tax return to receive an ITIN, unless they meet an exception.

You maybe an accountant but I am sorry, you are absolutely wrong! Please check your info again... And please do not stump someone the way you did.
