Affidavit of Support not sent before the interview - Is it possible to receive a visa anyway?

Hi. I just received an e-mail from my fiancé telling me that her interview today went very well - and that her visa was approved! She was told that she could pick it up in a week. However..., I am a little concerned that it may end up that she will still be denied... I know that the consulate officer has a great amount of discretion in what is accepted as proof of income, but I was wondering if it is possible to get a visa without having sent an Affidavit of Support at all. I have been looking for work for several months now, and more recently for anything I can find to meet the income requirement. The problem has been that I have not been able to find anything that I am qualified for, and I am overqualified for the jobs that cover the minimum income requirement... I was hoping, of course, that I would have a job before her interview, or at least I would be allowed to send it afterward.

I did send a copy of my tax return for 2009, as well as a copy of my most recent bank statement. Maybe that was sufficient for Bolivia? BTW, just in case the question is asked...I do not have anyone that I could ask to be a co-sponsor, or I would have done that as well...

Does anyone have any experience with this situation, or know of anyone that has? What would you suggest that I do at this point? Should I still send it to the consulate as soon as I can get it filled out (it does seem that this could be safe and possibly a wise action), or should my fiancé just accept the visa, and we leave it at that? Thanks in advance for your comments and advice.

I was wondering if it is possible to get a visa without having sent an Affidavit of Support at all.

That would be a first from what I've seen if it is true. The Embassy/Consulate didn't give your fiance any kind of paper(s)?

Seems way out of normal to be approved with no affidavit of support. Was your 2009 return (and bank statements) over the minimum? (Is it possible your fiance completed an affidavit 'for you'?)

I'm not sure of much of exactly what happened during the interview, and what papers they may have given my fiance. I will find out more later tonight when I call her. I was originally planning to be there with her today, but it didn't work out that way... I'm sure that she explained my situation to them and maybe that was enough - for now.

Yes, my bank statement and tax return showed that (at that time) I was well over the minimum. Although it is possible, I don't think that she would have filled out an affidavit of support for me.

Some consulates don't use the affidavits for K visas and even some that do, like Guangzhou sometimes don't ask for them during the actual interview. If they told her the visa was approved and to pick it up in a week, you'll have a definite answer in a week.

I remember hearing/reading that - wasn't aware it was still common in some places (especially the part about not needing an actual affidavit of support). It really demonstrates that while the affidavit of support is important (or even required), it isn't always the deal breaker - a lot of other things go into the decision making. I hope it did get approved and the OP will then have time to get things in order before he has to do it for real (stateside). good.gif

Right, never heard of anybody getting through AOS without a qualified sponsor's I-864.

I got packet 3.5 from the Islamabad embassy stating that I-134 is optional. I wonder whether they will require it for the interview? But it seems that it will remain optional and the real affidavit of support will be asked for once my fiancee is in the US.

Consulate: Islamabad, Pakistan

I-129F Sent: 2009-12-14

I-129F NOA1 Received: 2009-12-17

I-129F NOA2: 2010-03-02

Current status: Received Packet 3(yet to submit required docs)

I think if you did a survey that the I-134 is optional in a lot more consulates than you might have thought...

YMMV

As a general rule of thumb, it is recommended to provide optional information (or at least have it prepared and ready if requested), rather than risk RFE for not having it available if it is requested.

Payx,

I'm pretty sure in Kiev, for example, it's an optional thing. As long as there's financial info present (tax returns/pay stubs)
