Hello,

Today i got my package back from USCIS stating that they received my application prior to 90 day period.

Now i have to re submit my application. My question is :

1> Do i need to mention in cover letter that i am re submitting my application and provide them with the copy of Notice of Action.

2> Should i send the same application form and Check. As Application form has the stamp of the date received and Check has the stamp mentioning "For Deposit Only".

Any help will be appreciated.

No, not really. Doesn't server any purpose to do so that I can see.

Sure, why not? They didn't mark it up did they?

1. No - not needed.

2. I would suggest you fill out a new application form and check - to avoid any issues.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thank you for the reply.

1. The reason i want to mention that i am re submitting the application is they have punched holes to put in a file in all the documents that i have sent.

2. I will fill out a new application and new check.

When does your (conditional) Permanent Resident Card expire?

06/26/2010 : Received NOA
03/20/2012 : Received RFE(I-797E)
05/23/2012: Application approved after RFE response
06/29/2012: Received letter from NVC

06/03/2015: Change petition from F1 to F3 category

2. Parents AOS
3. I-130(Son)
4. N-400(Spouse)

5. N-400(Parents)

My Conditional Card is expiring in second week of June and USCIS received 1 day prior to 90 day period so they returned my application.

Does USCIS know that i am resending the application? The only reason i was planning to send a copy of the returned Notice of Action was all my documents were puched with holes to be filed in a file. Please let me know if i can send the same documents or need to prepare all the documents again.

You can re-send the same documents.
