We used my husband's parents' adress as main address for all the USCIS paperwork. He is PCSing in a month and now we're wondering if he has to send in I-865 Form even though we are not giving his new address to USCIS or NVC (in the future).

We wanted to keep his parents' address because it's too troublesome to change it in the process and one thing less that we have to do.

Is it okay this way or does he need to give his new address (he doesn't have one yet since he will look for a house when he arrives in the other state) with the I-864 anyway because it's for a different reason?

You have 10 days to change the address after you move.

Failure to do so can result in revocation of status as keeping your address up-to-date is a requirement. Sponsors address change is done using form I-865. The non-USC (LPR) needs to submit an AR-11 for their address change.

You can try it if you like but until he is a Naturalised citizen he must keep HIS address, and his sponsors address up-to-date. You may wonder how they'll find out and there's no way to know for sure but I know I definitely won't be risking it.

He is moving (army PCS) but we're always using his parents' addres (home of record in army terms) for mailing because it's easier.

So in this case, they are really asking for the residency address?

I just checked the form again and saw there is mailing and residency address. So I guess I understand now.

MAybe we should just wait to fill this out till he finishes moving...

If it won't delay anything, sure. Otherwise, using his parents' address for both is just fine. One of the answers above misunderstood the term AOS to be adjustment of status instead of Affidavit of Support in an immigrant visa case. Any requirement to keep USCIS up to date on your address is for after you enter the USA as a permanent resident. Right now you aren't dealing with USCIS. You're dealing with the Dept. of State's National Visa Center.

Nope it won't. We are taking our time with this but want to be informed anyway.

We are not in NVC phase yet. I forgot to say that. I'm flying out to see him before he moves, after the move he has to go on training for a new assignment so I'm reading about the paperwork so he can keep his mind on getting everything done for that and we will talk about this when I'm there.

Just clearing up things I don't understand so he doesn't have to do it in the end and we don't have to think about paperwork in our precious time together.

This is why I got confused about moving anyway but then it ocurred to me that we never stated his residency address before and never need it till the AOS form.

So he will put the mailing address of his parents and residency address for his new home. I think him moving and the AOS being requested after that will work out nicely. (Provided that everything is okay with the application of course.)

Oh and I understand that we have to keep out addresses (which will be the same then anyway) up to date until I can become a USC (or dual -hopefully- in my case).
