Change name for K2 Greencard possible?????........help pls.

Hi the issue with me is ..... i apply for my AOS with my K2 visa holder son. So when i filled-up his AOS form, i do it as how his name been written in his birth cert, passport & I-94 ... as 1stname-2nd name-mymaiden name, ... can any of these inquiries be possible??

1) Do i need to wait for his AOS result/greencard as how his name is? then do the adoption after AOS so he used my husband last name. and re-apply change of name??

2) Or could we inquire in USCIS when we do our interview in AOS, if they could allowed my son to use my husband last name for greencard & SSN purposes of identification use ...... before we go for adoption processing.

Bcos right now as he entered school, he used already my husband last name, and we was instructed that we need to apply my son SSN soon, but we want him to have SSN in my husband last name, the issue is ... our AOS in pending and it written in the way his birth & passport is. I thought that time when i doign my son AOS is that , we might conflicted the application by putting my husband last name to his in I-485 form, though in his I-94 is different??? was thinking if tehy will asked new birth cert of him or adoption paper???

any input in this will be appreciated... all i could read is only to maiden-marriage name change of the fiance here.

I believe you did the right thing. GC will be exactly the same as it appears on his passport. If you want to change the child name you will be asked to provide the adoption decree probably the same thing when you applied for his SSN. Yes it's like when fiancee want to change the name after marriage,he/she will asked to provide marriage cert. to change name to his/her married name.

Thanks! I was just really confused ... bcos adoption takes awhile for us, since i need consent from my son father in Phils eventho we never been married or live together. Our attorney says it will be needed in judge, does US court doesnt allowed "illegtimate" case???

I can tell you that SSA isn't going to let you put your husband's last name on the child's SSN record unless that's the name on his I-551 card or you have adoption papers or made a legal name change in that name.
