K1 if I am not yet a US Citizen?????

Hello,

I have just got off the phone with a USCIS call center employee who says that as a Resident Alien, I cannot apply for my fiance to come to the US. She said that I can only apply for him to come if I am married to him.

I am soon to become a US Citizen but I would like to start the K1 process now. I am being told by USCIS that I cannot make the application until I am a citizen.

Does anyone have any experience about this or knowledge?

It's much appreciated.

From what I've read, the USCIS person you talked to is correct. You have to be a USC to apply for a K1. Correct me if I'm wrong, you guys.

I only offer advice - not even legal. Just the plain and simple kind.

Your right, non USC can not apply for fiancee visa, they can however apply for spousal visa

You can not begin the K1 process until you have citizenship. If you were to marry now and file the I-130 as a permanent resident, you can later change your status from LPR to USC. The I-130 can be started as an LPR then switched to USC, but the K1 can not.

So I guess all this means... what comes first, you becoming a USC or your next meeting with your fiance? Because if your next meeting with him comes before getting your citizenship, maybe you should marry him and file the I-130 so you can get the show on the road. ;)

One of my friends having H1 visa married a foreign girl and brought her to US very easily and quickly under non-immigration visa (H4, I guess). If you are not a US citizen now, you might follow my friend’s way.

Sorry about previous reply. You cannot apply H4 visa for her because you are under green card.

You may wait till you become a US citizen and apply for K1, or you get married and apply for K3 visa.

The answer is that you can apply and pay the $170, but your application will be rejected and you will lose the cash. The choice is yours. Either wait until you are USC then apply, or just apply and donate the extra $170 to your government of the day.
