urgent help needed, AOS, co-sponsor question

My husband and I both graduated in 2009. I am currently unemployed and he is making 70k annually but only 9k last year and 5k in 2007 since he was in school. We asked his parents to co-sponsor me when I was filing for I-129F, the fiance visa.

My question is that whether it is required for his parents to co-sponsor me and fill out the I-864 since they filled out form I-134 for me? If not, would his limited history of income satisfy the requirement? We have his tax return forms and W-2s for 2007 and 2008, W-2 for 2009. Are there any other documents we are encouraged to get? (I don't think we will have enough time to get his tax transcript)

What is important is that your/his current income is above the minimum - not what is on previous income tax returns. To prove current income, you'll need pay-stubs or some other way, depending on how you're paid. $70k/year is more than enough to not need a co-sponsor. How long has he been in the position he's in now?

Thank you so much for the quick reply. As I said, we graduated in 2009 so he's been in his current position for 8 months. His income this year will be around 30k.

8-months should be plenty - am confused about the $30k-thing though. Do you mean $30k so far? If so, that's not a problem - they will annualise his income (multiply his weekly/bi-weekly/monthly income by the number of those in a year) to come up with a yearly income.

Yes, 30k so far. I am planning to include his w-2 this year, direct deposit and pay raise letter. Would these be sufficient or should we include more documents?

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”
