I got the I-130 (Petition for Alien Relative) from the us embasy website and is almost full . Only need in the form is the date of marrige . I already give my kid my last name .I have a copy of his colombian birdth certificate . DO i also need to fill out a K3?

Also i been told that as i enter this document i also need to enter 2 years of tax returns /pay stubs from my job . utility bills copy of my passaport /license/ Health insurance card ?

Please let me know wish form and how to proceed . I can get the forms online / They are really easy to fill out i only want to make sure i summit all documents. I been asking her to keep records af la gifts and support that i been sending to my family .

Also as my fiance and myself already have a child as i explin before that i miss so much . Will this help on the process? I been told that can take up to a year .

AND AS IM GETTING MARRY THE LATES THIS SUMMER I WILL LIKE TO ACELARATE THE PROCESS. any help will be apreciated .

My writting english is not the best however i was born as an american citinzen my mother / father / grand parents are also us cittizens .

Hello....a bit confusing but I will try to help you.

You are not married so you cannot file for anything except a Fiance' Visa (K-1/K-2). Since you are a U.S. citizen, your child is automatically a USC also. You did register/notify the local embassy in Bogota, I presume. Are you living and working in the USA now? You do not have to have anything relating to your tax returns until the final phases of your petition process. Read the guides on this forum and things should be somewhat clearer to you. We were all "newbies" at one time. The process is pretty straightforward and you can do it yourself. You need to be careful with the way you word your questions on this forum. Most people want to help you but the clearer you can explain yourself the better off you will be. For example, this woman you refer to is not your "wife." She becomes your "wife" at the wedding, do you understand my point? At that point, you can petition for a K-3 Visa for her. IF the child is yours, you can get a U.S. Passport for him/her with very little effort. In fact, when this child has a U.S. Passport...technically, you could travel to the USA with the child and a "permission to travel" document signed by the mother.

PS There is no way to speed up this process...it takes as long as it takes to process the people who filed before you. Explaining that you "miss someone" does nothing to help your cause. We all miss our girl/boyfriends or wife/husbands. You must learn to have patience with this process.

03.16.2010 I-797 NOA-2 Approved and sent from California Service Center 71 Days from NOA-1

03.16.2010 USCIS sending notification of the approved application/petition to the National Visa Center.

03.23.2010 NVC sent file to U.S. Embassy in San Jose, Costa Rica! SNJ2010XXXXXX

03.26.2010 Received NVC letter (hard copy) dated March 24, 2010 in the mail.

03.27.2010 File arrived @ U.S. Embassy.

04.07.2010 Embassy called for Elsie to come and get Packet #3. She will pick up April 13th.

04.08.2010 Embassy e-mailed Packet #3 to me today.

04.15.2010 Interview scheduled for 30 April 2010

04.30.2010 Visas approved...pick up everything on 5/4/2010 @ 3pm.

05.05.2010 Traveling together to the USA...POE Denver, Colorado

07.28.2010 Married today...end to a long journey with more to come!!

PSS Just curious...why doesn't the child have a U.S. Birth Certificate? If he is your child, he qualifies to be a USC. And, you can't do an I-130 because she is not an "Alien Relative" of yours. At this point, her status with you is simply the mother of your child. And, your fiance', of course.
