I posted before on this I sent all needed inforamtion for change of status, work papers and travel permit, I got the notice that Chicago got the stuff then got the date which is this Friday I then receive a yellow paper today saying that the medical was no good I'm guessing since it was a year and 2 days, Anyhow how do I A] go about getting the medical without having to go to doctor I have my wifes 2035 here B] what do I do about apointment this friday? will they just reschedule when I send in the new medical?

What you got, sounds like what is called an RFE (request for evidence or request for initial evidence). It might be helpful to folks answering your question if you post exactly what the RFE/RFI is asking for.

(If a medical is needed, you can not get one without going to a doctor - specifically, a Civil Surgeon. But we don't know, yet, that you do need a new medical.)

Moving from General Immigration forum to AOS forum.

this new setup is a little confusing I used to just go to post manager and lool at my last post and look at reply, but yes is definatly looks like RFE the medical like i had said ran out and I think they tagged me for that the paper just state go to surgeon and get signed physical....so how do I go about getting this without having to go to surgeron for full physical and do I go to hearing this friday or does it have to be rescheduled?

Yellow paper just says get physical and send this sheet in with the signed physical.

You can't. One of the requirements for AOS is an up to date medical examination by a Panel Physician (outside the US) or a Civil Surgeon (in the US). They are valid for one year. If yours was one year and 2 days old when you submitted the AOS application, then the medical is invalid and you still have not met that requirement. It is impossible to go about getting the medical without going to a surgeon for the full medical. That is what the RFE is for - you need the full medical because the one you submitted was no longer valid. There is no way to get around it.

If you have any sort of a hearing or an interview you need to go. If you fail to show the whole application may well be denied. Even if your application is incomplete you can still attend the interview/hearing and let them know you are in the process of getting the necessary information. (You may still have time to get the medical done before Friday). They may then 'defer' on a decision until you provide the missing information. If you do not provide the missing information then your application request will be denied. It is virtually impossible to reschedule AOS interviews/hearing dates unless it is a matter of life and death. They expect you to make this your priority.

So, please, stop trying to avoid doing the obvious. If the AOS is at all important to you then you will get the full medical redone, bite the bullet and pay the money (if the AOS is denied then you have to re-apply, pay that full $1010 over again and STILL need to pay for the medical).

What will happen is you MUST attend the interview and if they approve you, they will approve you based on waiting for the medical results. So, you will get the medical done (preferably before the interview honestly if possible) but if not, after the interview you'll have it done and then mail in the RFE stuff and then they'll process your case to send you the card.
