Does your own money count towards this? I do have a sponsor and filled out the addivant of support forms but my dad is going to give me 10k in cash to take with me...will this count too?

If you have it in the bank and can show that it can't do any harm, but in reality that amount is a long way sort of what you would need in assets so doubt it will make any difference unless your sponsors income is close to the requirement.

I am worried as I have no savings, I did but they soon disappeared with all travelling back and forth to see my lady in the US as I'm sure you all know ! We have found a sponsor who earns a lot of money and has no dependants which is great but my fiance in the US doesn't earn anything and I send her money to live on. We are gonna be trailer trash lol! She is living in a trailer that we bought and we also have a good car now. This is the cheapest way to live but I'm really worried about the money situation.... I have the interview on Thurday 18th March, My fiance has filled out the affidivant of support forms too although she just had to put zero income....

The sponsor we have is great although I won't be taking any money from her as my father here in the UK will support me until I can find work but how can I convince the embassy of this when I have the interview. My dad said he would give me the bank statements from his business account to prove he has the money to give me, but if the sponsor earns enough won't that be enough??

I'm just so worried as I have virually no savings now and my fiance definitely has none.... Do they analyse all the forms at the interview or do they just take them from you and they get looked at later?

Also, from what I have read, I couldn't possibly claim any benefits in the US anyway so how could I become a public charge??

I have always worked and held down the same job here for the last 15 yrs so maybe they have checked that and it might be a help.

They will examine the information given by your sponsors to make sure it fills the requirements, which are those that you have no doubt already read and are aware of. If those are met then they do not look any deeper. If it is border line on the sponsor(s) meeting the requirements they would want to make sure it is all in order. As you say your sponsor(s) well exceed the requirements I doubt it will be questioned.

I have the wage slips and bank statement from my sponsor plus social security and inheritance letters to show the amounts she gets paid but I don't have the tax returns! On the Embassy website it says I must have 2 or more from the list...I'm worried now that they will ask for tax returns too as many people seem to have had to produce them.

I have her bank statements showing her wages and social security payments, will they be enough? Her income from her inheritance alone is more than enough for the requirements so should this be ok?

Pretty sure they will want at least the latest years tax return. As 2009s doesn't have to be filed until April 15th they will probably ask for the 2008 one at least. If you don't have them all you can do is go the interview and see what happens. If they ask for them you will have to get them and send them in. Never can tell for sure, what you have may satisfy them and you will not need any tax returns.

I think something that is a life long income like Social Security is a good proof of income. Everyone on SS gets a letter each year telling what their benefits are for the new year. That would be good to have and would be like an employer's letter. Is that what you have? Is the inheritance monthly and you have a letter showing that amount?

I think if those things are in place and are documented in letters, not just random deposits on a bank statement, then that's good. They are interested in the stability that the income will continue. London has grown to expect to see a tax return just because it's probably the most common thing people bring. They clearly do not state you must bring one. Most likely the lady at window 1 will say, "where's your tax return?" out of habit, but you can explain that you have brought two other proofs and it should be just fine, especially if the income is way above the guidelines.

Also take something from the joint sponsor that shows her legal presence in the US like a US born birth certificate, a US passport, naturalization certificate, etc. (photocopies)

As soon as you marry, you will file for AOS. You will need another Affidavit of Support (I-864) done by your wife and the joint sponsor. That will require at least the latest tax return (2009 return by the time you file.) And if you make photocopies of the sponsor letters now, you can use them again. What I mean is don't give your only copy to the embassy.

So, I can't file for the AOS until we have been married..? When can I apply for the EAD, as I need to get work asap, as I guess most people do if possible. Can I apply for the EAD before we get married?

You can get a SSN before you're married but everything else is dependent upon your marriage. You can file everything after the marriage.

That sucks I was hoping I could file for the EAD as soon as I arrive with the k1 visa! So, once I'm there with the visa, what else can I file for before we get married..? Nothing? I read that it is possible to apply for EAD but it could take 3 months and it would expire then anyway?

If you use JFK as your POE they were the only port in the country that would give you a 90 day EAD when you arrived. Not sure if they still do, haven't seen anyone comment on it for ages, but in the past people deliberately used JFK for that reason. Some research might be worthwhile.

If you use JFK as your POE they were the only port in the country that would give you a 90 day EAD when you arrived. Not sure if they still do, haven't seen anyone comment on it for ages, but in the past people deliberately used JFK for that reason. Some research might be worthwhile.

They still issue the EAD stamp but apparently it's worthless now.

OK, I have done some research about this and apparently most employers won't employ you even with this stamp, they still want to see the EAD. This may not be true, just what I read. Anyway, why would only JFK do this? Will it still be valid in California, as that is where I'll be heading to.

Immigration law is Federal law, not State law. So yes it's the same all over the US.

To answer your question about JFK, there have been spotty reports through the years of other ports of entry issuing the stamp. But it's worthless now anyway, so the discussion is moot.
