If I were to marry my boyfriend during his leave from Iraq (he is currently deployed) would this be proof enough that we are not being fraudulant, seeing as he will be leaving the US to go back to Iraq after 2 weeks and I will be coming back to my country to start my CR-1 app?

So long as you return to your country before filing for your visa, you're fine. Coming to the US with the intent to marry isn't wrong. What's wrong is coming to the US with the intent to marry and adjust status to circumvent immigration laws.

Good luck and congratulations!

No problem getting married in the US, but he needs to petition for your CR-1. US family-based immigration is usually a 2 step process: the USC files a petition and then the beneficiary applies for a visa once the petition is approved.

The good news for you both is that as deployed military, your fiance has access to the military helpline and you'll probably qualify for expedition on the basis of his current deployment.

Make sure, since you only have 2 weeks together, that you really read up on the CR-1 process and he has given you all the documents that you'll need from him for your interview. If you get an expedite, he might not even be back from deployment before your visa is processed.

Good luck and congrats - and please thank him for his service on my behalf :)
