Already married - can I use VWP to come and adjust status?

I am a UK citizen my wife is (United States citizen ) we got married in the US and have been married for over 5 years can I get in to the USA on a VWP then go for a green card once i am in the country?

No, you cannot use the VWP to come over and adjust status (aka- get a greencard) with prior intent (which you certainly have shown). You may use the VWP to visit, and visit only. The short answer is 'Not really' - you can try but you may be attempting to circumvent US Immigration Law(s) by doing so.

The good news though is that you can get an IR-1 visa and get a 10 year green card instead of a conditional 2 year one since you've been married for 5 years.

Naturalization

9/9: Mailed N-400 package off

9/11: Arrived at Dallas, TX

9/17: NOA

9/19: Check cashed

9/23: Received NOA

10/7: Text from USCIS on status update: Biometrics in the mail

10/9: Received Biometrics letter

10/29: Biometrics

10/31: In-line

2/16: Text from USCIS that Baltimore has scheduled an interview...finally!!

2/24: Interview letter received

3/24: Naturalization interview

The good news though is that you can get an IR-1 visa and get a 10 year green card instead of a conditional 2 year one since you've been married for 5 years.

Where is your wife at? If she is in the UK with you, you can also do the DCF. Otherwise you have to get an IR-I as the people already said.

08/2006 met in GA, U.S.

05/2007 Antje had to go back to Germany

10/2009 got engaged in TN

12/31/2009 got married

1/7/2010 I-130 sent

1/9/2010 I-130 delivered

1/13/2010 check cashed
