I really need help!!

Timeline

hi, Nothing seems to be going right for me right now :( today I got layed off from my job (which I have only had for 3 months), So I realy need to know a few things so that we can weigh our options.

If I get a job in the next month or 2 can I still be his sponsor (considering the salary fits criteria) or do I have to work at the job for a certain period of time?

If I do get a co sponsor, what exactly would be required of them? will they have to know exactly what type of visa they would be co-sponsoring? I ask this because I would want my father to co-sponsor my husband, but we eloped and he has no idea we got married (we couldn't afford to have the wedding we really wanted) and I don't want him to find out this way. Would a co-sponsor have to do anything other than fill in paperwork, and give pay stubs and tax returns, or is there more to it?

One more question, If we do get a co-sponsor, could I live in Ireland with my husband while the visa process is going on, or will I have to stay in the US?

Any help would be soooooooooooooooooo much appreciated!!!! I'm so stressed out it's ridiculous!

Sorry to hear about the job :(

My understanding is that they want your projected annual income for the I-864, with proof that you are earning it. If you met the income requirements over the past couple of years, you'll be submitting your tax returns for those too. It shouldn't matter that you haven't earnt it yet or that you only recently started a job, but it has to be a permanent one and not agency/ temporary contract.

I think the question about your co-sponsor is a moral one, more than technical. It sounds like maybe telling your father might jeopardize his willingness to act as a co-sponsor? I can understand eloping, but he's going to find out sooner or later. Asking anyone to undertake a significant financial responsibility for another person, without being honest about your relationship with said person isn't fair, IMHO. I would reconsider how you wanted him to find out, and "man-up" and tell him. I'd do just about anything for my kid, but I would be devastated to learn that she'd asked me to help in this way only to learn afterwards that she hadn't been entirely honest. I appreciate it's a personal issue, but consider what he's doing for you by sponsoring your husband and pay him the respect and courtesy of telling him that you eloped.

You can visit or even move to Ireland to be with your husband during the process. It's hard to offer advice or opinion about whether it might be the better way forward right now for you both. If he's secure in Ireland, then could he support you to go there for a while? You'd be able to re-start the process from there, have dealt with the issue of telling your father that you're married and he could act as your co-sponsor then.

I googled "spousal immigration to Ireland" and this is what I found:

"I called the Alien Registration Office. Here's their answer. If, upon passing through Passport Control, the non-Irish spouse is asked the reason for their visit, the complete truth is the best response. The non-EU spouse should tell the Immigration official about the marriage to an Irish citizen. If asked, he or she should explain that the two of you are planning to move to Ireland.

Make sure you have an official stamped, certified copy of your marriage certificate with you!

If you're coming via plane from outside the EU, you'll probably pass through passport control together at the overseas airport and there shouldn't be any hassles.

Since a spouse has a legal right to reside here with an EU citizen, there should be no problem in just passing through passport control in the simplest way possible - assuming the non-national is not from a country requiring a visa to simply visit Ireland. If he or she does require a visa, you'd best contact your local Irish embassy for a visa - explaining the situation and providing the documentation."

and the Irish Immigration Service has this information on their website:

10. REGISTRATION AND PERMISSION TO REMAIN

Non-EEA nationals, who wish to remain in the State for longer than 90 days are required to register with their local Garda Registration Office [Garda Immigration Registration Office, 13/14 Burgh Quay, Dublin 2; Telephone (00 353 1) 6669102 for persons living in Dublin Area; local Garda Superintendent's Office for persons living outside Dublin] and obtain further permission to remain.

I can't answer everything you have put in above but I will do my best with what I know.

I'm so sorry about your job - that must be so stressful for you. You can sponsor your husband with a job you have been working at for one day or 10 years...you just need the tax returns for the past 3 years to show your previous/current income.

There is no 'requirement' of the co-sponsor. They just need to be able to prove they can support your husband financially and doesn't become a charge of the state. If you live with the co-sponsor, they will fill out an I-864A. If you don't live with the co-sponsor, they fill out an I-864. My father-in-law was my co-sponsor and we needed to show his previous 3 years worth of tax returns and W2's. There is no other obligation of them (aside from providing for your husband financially if necessary).

Not sure about living in Ireland - maybe someone who has experience there can answer that one for you. Best of luck and I hope I have helped somewhat.

Will the co-sponsor also need pay stubs, or just the past 3 tax returns and w2s? Also, Can I download the form and get everything prepared now, or do I have to wait for the noa2?

Same things you will need to supply and don't forget their proof of citizenship. You will still need to be the main sponsor, even if your income doesn't qualify you. You can start gathering documents together now, because things like your 2009 tax return will not change, but keep in mind that paystubs and employment letters should be dated close to the interview date, wherever possible.

I didn't realize they would need proof of citizenship. Would that mean I would have to get an orgiinal brith cert off of them? Or what would suffice?

There's no way your father could sponsor your spouse without knowing he's your spouse. Take a look at the I-864 for confirmation.
