I found out my wife has been unfaithful to me. It happened right when I finished with the NVC. I now wish to get a divorce and I don't know where to start. Can you help me out please? Thanks.

Let you fingers do the walking, start with the phone book it's full of divorce attorneys.

hmmm divorce is never quick and simple. I dont know how you would go about that...talk to a lawyer at least. Laws vary by state.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

is she in the states or in Thailand? If she is not here then jsut terminate the visa process.

Usually, a divorce is filed at the county courthouse. This varies by state, of course - but...

get over to the county courthouse - inquire about 'how to file' - then ask where the law library is, for the county courthouse -

then - befriend the law librarian at the law library - ask to see a current 'template' for filing divorce.

Most states allow for a 'waiver for appearance' - which must be filed with the court. You can get one prepped, send to her, have her sign it (suggest at the USCons in Thailand, for the stamp) then send it back to you, to file.

This question made the most sense.

If the visa process is terminated, you can probably get a divorce with minimal pain,

perhaps an annulment if that applies.

:thumbs::thumbs: This is the BEST answer out of all of them. Why oh why do people come on a vsia board to ask about something that is being done on a daily basis rght here in the good old USA (the land of fredom with the right to divorce.

I believe he wanted to know how to obtain a div from someone who is not presently here in the US. The best advice is to seek a lawyers opinion.

Terminating the visa process doesn't terminate the marriage.

It's good to have stated that clearly.

Two possible criteria for annulment that you may be able to utilize:

If a person entered into the marriage as a joke, on a dare, or without the intention to truly be bound to it, then the marriage may be annulled.

Finally, if a person entered into marriage because of a belief and reliance on untrue statements by the other person, then an annulment may be possible.

Can this marriage be annulled?

Be sure to find rules for annulment in YOUR state if you think that's the best route.

Another thing you can do also is to try and forgive her. talk with her and see if she is genuinly repentant. Did she confess this herself? and is she sorry? if you guys are in love, I think you should forgive her and go on and have a good life. what makes u think the next person would be perfect? This woman may be the best thing that could happen to u after all. The devil u know is better than the angel u dont know. Work on ur relationship.I know a couple that had same problem(guy cheated) and there was lots of pain but for love's sake there was forgiveness and they went on to have a wonderful marriage. We all err sometimes. Good luck :innocent:

First you need to terminate the visa process. that's the first step. then you can worry for your divorce.

NVC Journey Dec. 2009

Dec 4: wife's case was entered at NVC

Jan 08: Sing in failed......wow thanks GOD. Jan 11: CASE COMPLETE TOTAL TIME 24 BUSINESS DAYS OR 38 CALENDAR DAYS FOR CASE COMPLETE.

Feb 5: Interview date scheduled. Interview on March 23, 2010

Embassy Journey 1.0

March 23, 2010: Interview date. Wife placed on AP, Baby required new birth cert.

April 21, 2010: Wife out of AP she needs to get an approved I-212 from USCIS, Baby birth cert. issue resolved.

Sept. 9, 2010: I-212 Approved

Sept. 22, 2010 New Interview date.

Sept 22, 2010 VISA APPROVED.
