bad news from the DOS today!!!!!

hi guys

i just called DOS today as usual --- 3 times a week- to ask about my wife case K3 , according to DOS operator : she is qualify but there is no schudule yet , by the way she sent her package 3 in October 2009 wich is 5 months of waiting .

today i got a good surprise from the DOS operator wich is : there is no K3 process in Monteal any more !!!!!! what ?!!! i mean guys i have been waiting for 5 months for her interview date and now u telling me there is no process for the K3 !!!!!!!!!!!!!!!!

i called NVC to see what going on and according to them , the change was in february ! but i didnt receive any information by mail or email !!!! plus that why the operator of DOS never told me about this change ?!!!!!!!!! and how come this new change gona go back to my wife case !!! it should go with the cases after febryary !!!

i dont know who iam gona talk to ?! do i have to precess the I130 and wait another lonnnnnnnnnnnng time after we were wishing her interview will be soon ?!!!!!! iam getting really tiredddddddddddd and i have no adea what i have to do

any help plsssssssssssssssssssssssssss

Means you have to do the NVC processing. It is an immigrant visa (actually better IMO).

Removal of conditions Journey

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

they have been approved together in september 2009 , is the change gonna affect me ? or just the people who applied after february ?

As far as I know, if the two were approved on the same time, they will cancel the K3 and process the CR1 category. You should call NVC and find out if you have a case number assigned to your CR1 case.

I assume that it applies your case as well regardless of the date of approval.

They're trying to eliminate the K3 visa because it's obsolete.

It used to be faster than CR-1, but since they're about the same now, they want to get rid of K3.

It most likely will not take 6 months to finish this visa, from what I've seen alot of people get through NVC pretty fast. You better start reading the guides and wiki and such because they're having you go through the CR-1 route now.

It's better in the long run anyway.

Correct word would be "administratively closed". Read the following notice posted by DOS.

Since your I-130 is approved at this time you don't have to wait for 6 more months. you can proceed with your immigrant visa (CR1).

When was your petition approved? If it was before Feb 1st, you should not be subject to the new rules.

they approved the I130 and the K3 in august 2009 and the new rules came in February 10-2010 !! I // she DID NOT receive any information about the new rules by mail or even email !!!!

the consualt in montreal sent her package 3 including the doctor visit in september 20-2009 , my wife sent the package 3 back in october 23 -2009 !! the change was February 10 -2010 , so how come they wana make this new rule for my case that was approved before the change !!! after i have been waiting almost 5 months and hoping for her interview date !! by the way i stopped processing the I130 since i went with the K3 . i have told that gona be quick than I130 !!!!!!!!!!!!!!!

but ... you've had K-3 momement AT the Consulate in Montreal already.

IMO - something is messed up - the casefile already left NVC, way way way prior to the FEB 1st cutoff date.

IMO, the Consulate IV unit should be driving these steps of the process - so you might have some luck with the IV unit in Montreal , to keep the K-3 in play there. You won't know, though, until you contact them. I suggest fax. Good Luck !
