I tried the search function but could not come up with a definitive answer - can someone please answer this for me:

Situation: U.S. Citizen, married to permanent resident. Couple wants to bring the two daughters of the permanent resident to the US. Can they both be applied for on the same form, or do individual I-130's (and all supporting paperwork individiually submitted as well) have to be submitted for each of the two kids?

Thanks kindly.

The USC spouse will be the one sending the I-130 based on the step parent relationship as long as the marriage took place before either childs 18th birthday.

When I did it both petitions were apporved together and went through the NVC together. Applied May 07 bith boys were here in the US on 3/1/2008.

Please remember if the childrens other parent is still alive you will need a notorized letter stating that said parent allows the children to come to the US to live permantly, this will be needed at the NVC stage to avoid an RFE.

Why is it that the only one who can stop the crying is the one who started it in the first place?

How old are the daughters and more importantly, how old were they when they became a "stepchild" of the USC?

YMMV

I'm in a similar process w/ my 2 step children. I filed both i130s together (same envelope, 2 applications, 2 fees) and the cases have travelled along together. they were approved in january and are marked as "related" .. for the affidavit of support, i was only charged once.

this discussion brings up a good point though, i am about to file their choice of agent and affidavit of support forms, should i also ask their mother (whom they currently live with in brazil) to go ahead and do that notarized letter that says she allows them to come and live here? should i send that in w/ the forms, or just seperately when it arrives by mail?

thanks!

I would send the letter along when you send in the DS-230. As this is the application for them to come here to the US. Good Luck :)
