K1 Application - Question #11

I have a question about #11 on the K1 Application. In 2001 my ex-wife got her permanent residency through me filing a family member based app. We divorced in 2008. Will this make it harder for me to process a K1 for my current Mexican fiancee? I want to file it this week, and we have everything in order.

Also, when I put my ex-wifes a# on the app as an answer to question #11 what does this do? Does anyone have any insight into this? I really don't want her to know what i am doing, nor do I want it to trigger any kind of searches that may affect her (she has been arrested for criminal trespassing before). I would feel bad if I was the cause of any trouble for her, plus she would probably make my life miserable if it was because I was trying to marry another Mexican girl.

No - it won't make it harder, you will just need to provide the divorce decree with the petition.

They most likely use the A# for paperwork tracking purposes, to do any follow ups if required. I doubt it would cause any issues.

Since she is your "X" - I would forget about her and move on with your new fiancee. (but I'm cold like that)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I had the same issue. I didn't file a K1 for my ex husband but we did do an AOS and I was a wreck thinking it would look bad. It had absolutely no effect on the K1 process.

You may receive some extra scrutiny throughout the process because it's not your first time. However, you are filing a petition, not a visa application. When your petition is approved, your fiancee will apply for a visa.
