Hi everyone , I am helping a relative to fill for AOS

he lost his job last oct he is 3,000 short on the poverty guideline

he got well over enough liquide asests to cover the 3,000 x 5

my question is,

since his income was short but he can prove he got liquid cash does he still need a co sponsor ?

Even though he has liquid cash; i personally would not risk denial. Get a co-sponsor to sign off they will help if necessary. A parent is the most credible. The government doesn't want to risk financing your future spouses future. Cash can be spent and then where does that leave you - denied. So get a co-sponsor even though your friend may never need to use their help. Remember they are looking for reasons to say "no" do not give them that opportunity. My two cents

Is he currently working now?

If you answer "no" then get a co-sponsor.

If you answer "yes" then you need to find out if he is making the poverty level now, with 2010 income.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

thank you for the respons at the moment he is unemployed , so I will tell him he needs a co sponsor

I got one more question they also got a child he will sponsor I looked at the example forms but cant see any examples for filling out a I 864 for a child , is it the same way as for the wife ? they came on K1/k2

correct me if I am wrong but i belive he has to fill one for each right ?

and since he needs a co the co will fill it out just like he does , am I correct ?

Yes - you can make a copy of the primary 864 and include it with the childs application.

You must submit a Form I-864 affidavit of support for each intending immigrant you are sponsoring. You may submit photocopies if you are sponsoring more than one intending immigrant listed on the same affidavit of support.
