Hello everyone, I am a us citizen and I am the sponsor for my husband, he has had his first interview and his visa was denied due to lengh of stay illegally here prior to filing. We had to file a I601 waiver and it clearly says in the bottom of the page that it takes 9 months to 1 year for them to schedule and interview for the waiver. I have included several medical records. I need surgery and we have 2 little ones that are here with me and I have been caring for them on my own. I cannot have my surgery until my husband comes back because I have no one to care for my children while I recoup. My quetion is: Did anyone not have to wait the whole 9 monthsto 1 year for the waiver? Is there anything I can do to expedite this process?I am wondering if things move faster at different locations also. He is in Brazil I dont know how long they take over there. Any info would be really appreciated thanks.

hi,

I waited 7 months for my I601 to be approved, and never had an interview for it. It surely different in every country though, some people have to wait longer i'm sure. My process wasn't pleasant, thats for sure :) But i'm just so blessed that it was eventually approved.

Oct 2005 - met my baby

Dec 2006 - he proposed

Feb 2007 - K-1 filed

Dec 2007 - K-1 Visa Interview (denied), the reason: i was overstayed my previous visit in 2000-2003 (my bad)

Feb 2008 - I-601 Waiver filed

Sept 2008 - Waiver approved (K-1 Visa issued)

Jan 2009 - the Wedding Blessing & Reception (Bali, Indonesia)

Feb 2009 - Arrived in the US followed by the Civil Wedding & Reception (again:)

March 2009 - AOS filed

April 2009 - Biometric

May 2009 - EAD card in hand

Aug 27th 2009 - AOS Interview (approved, yaay)

Sept 2009- Green Card arrived in the mail...yippeeeew...(i want to sing of Your Love forever)

June 2011 - ROC filed

July 2011 - Biometric

Dec 2011 - ROC approved (Best Christmas ever, i must've been a really good girl this year :)

The wait would be unbearable but it'll be worth it. It strengthens the love, it attaches you even more to each other, it shows how your man would do whatever it takes to be with you, that he will never give up on you because he LOVES you!! All the waits, stresses, tears, heartaches, all the miserable feelings you feel along the way will be paid off once you get what you've been hoping for...oh and WITHOUT PRAYERS? will be like trying to start a fire with water, JUST WON'T WORK!

So, you already filed the waiver right?

Processing times vary from consulate to consulate and depend on things like workload and staffing. If Brazil is telling you 9-12 months, you shouldn't expect the answer before 12 months. Also remember that the estimated time is just an estimate and the consulate isn't bound by that timeframe. Things can change which increase or decrease the wait time.

There is the possibility to expedite waiver processing due to an emergent medical situation(often life or death) or upcoming military deployment. If you're able to postpone the surgery until he gets home then it likely isn't going to get you an expedite.

Hi, I was wondering how things are going for you? I am about to submit an I601 for my husband in Brazil. I am told they are very difficult. Did you have trouble with getting an appointment to actually submit the waiver application? I plan to fly down there for his consular interview (which will be denied) and then plan to submit the waiver right afterwards.
