Yay for filing taxes in two countries.

Just a quick question for those of you Canadians that are filing from the US for 2009.

I worked full time until Oct 2009 when I moved to the US and therefore, have to file Canadian taxes. In the section for my martial status, I put married because I was in 2009.. The nice man from the 1-800 CRA line told me that I should put n/a and a note that he is an american in the area that asks for his SIN and 0$ as his income. So I did that.

I also put $0 in all the other lines asking about my spouses income although I did not claim him as a dependent.

So after I did that and computed it all in I went from owing $600 filing as single to getting a $1450 refund filing as married with a spouse with $0 income.

Im just wondering if that's what I was supposed to do? Obviously he didnt make 0 dollars in 2009.. he made almost double what I did but none of it was Canadian income nor did he live in Canada at any time. It just seems weird putting $0 income for him. Should I claim his American income? Or can I take the refund and run :innocent:

I can't wait to get this cleared up so I can move on to filing my American taxes.. woohoo. :blink:

No, doesn't sound right at all. I assume you are using some kind of software - what did you put for your spouses province of residence as at December 31st? Non-resident?

If you aren't using software, then you need to read the guide :)

I actually printed out the forms for my province and filled them all out by hand.. I thought most of it was self explainatory and didn't have any trouble with it (or so I thought.) and I dont believe it asked my spouses residence - just his SSN and income info. I'll try to look for this guide =(

I used ufile.ca and my refund was the same with or without my spouse on there, I'm pretty sure.You should just try using ufile.ca, it's really easy and fast.

I also put his SIN as 00000 and $0 income.

We need to figure out US taxes this weekend. Ugh, it's so confusing.

Are you claiming any credits as married? That may do it.

I filed married the first year I moved (almost identical timing as you when I moved in 2007) and I put my husband's income as $0 wth a note that he is an American citizen...he didn't earn any money in Canada

I used Ufile as well and it was fine

03/28/11 - FP

06/17/11 - status change - scheduled for interview

06/20?/11 - received physical interview letter

hi

i called revenue canada yesterday

they told me i MUST claim married and where it ask for spouse sin put 000 000 000

i must list his usa income but will not be taxed on it as it is foreign income and by putting 000 000 000 for SIN that showes he is not from canada

this is what i was told

i have not done taxes yet so if this wrong anyone please let me know

yrs ago when i did my Cdn taxes, and was married (wife in USA,, never worked/lived in canada)--I called revenue canada, they told me to put in 000 000 000 for my USA Wifes sin and to ensure her income was more than whatever the personal exemption was. Think it was around $12000??? Doing it that way ensured I would NOT get any credits/deductions from her or for her! I put in 40,000 just to be safe and I attached a letter explaining the situation. cant recall which tax software program i used!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Yes actually, in thinking about this, it would only ask this if you were doing an actual return for her, which you aren't.

I agree with what everyone else has said, use software or, if you are going to submit a manual return, ensure you are taking zero credits for your spouse, then just include a note when you file that your wife is not a Canadian resident.

I believe this would be your last tax for canada.Are u also official informing CRA that you are no longer resident of canada and will not file the taxes anymore and this will be your last one?

Yes, I there is an area to fill in your departure date when you leave canada permanently. However, I will still have to file taxes for 2010 in Canada as I recieved EI payments for the first few months of 2010.

I've used ufile for about 3 years now I think it is, I really like it. Although you will only be able to print off the return and mail it, it really is a nice program. Actually I have all slips now and should be doing that as well, but I would rather post in this thread :lol:

I am using ufile too, its been really good so far! This is my Leaving Canada return as well, some things I had to manually adjust in the controls there is a link in there where it asks you if you want to claim the spousal amounts, if you do then you MUST declare the spouse's income.

Just wanted to clarify something too...I also starting receiving EI payments in 2010 but as far I understood it I will not have to file with CRA because I will have no other CAD income for 2010. From my understanding the 25% NR tax is your final tax obligation to Canada, BUT you can file as a NR and elect..( 216 or 217???I can't remember which one) to get a refund of the NR tax that you paid?! Does that depend on your gross USD income for 2010?

Not sure if this helps too...

But this is what I did for my "Final" Canadian Tax return in 2007...

Filed as "married" and put my other required information

Put my SIN #...and filled out my income (which was $0 at the time, since I was a student)...

Put my husband's SIN # as "NONE", since he is an American and has never worked/lived in Canada..

Put my husband's income as "O", since he has no Canadian income

Enclosed a copy of my US marriage certificate, US green card, US driver's license, Canadian passport

Explained in a letter: that this was my final tax return, that I would not be returning to Canada, that my husband is American, that I was an American permanent resident, and filed this final tax return to prevent tax fraud....

And told them not to send me any more GST rebate cheques....

Lol...Needless to say that had no problems with the information....

But..When it came to the GST cheques...They claimed that I owed them money there for cheques that I had already sent back..

Got that sorted out...told them I did send the cheques back....

But yeah..sure had a heck of a time with Revenue Canada about that one....

(see my former VJ posts about that one....I posted about that a few years ago...)

So if you ever get those GST cheques....do not cash them in if you are not a resident of Canada.....

Lol...Funny too, even after I moved I got an Elections Canada and a Jury Duty notice...but that's another story....(see other VJ posts about that too..)
