I need help about the K4 visa

Myjamwifey, I googled K4 visa and here are the requirements,

1. What is K4 visa?

The K4 visa is a nonimmigrant visa which allows the children of a K-3 spouse visa holder to enter into the U.S. and await the availability of an immigrant visa.

2. How do I qualify for K4 visa?

To qualify for K-4 visa, you must be:

• Less than 21 years old

• The unmarried child of a K-3 applicant

• Seeking to immigrate to the U.S.

Your timelines says you did a CR1, so how can you apply for a K4, is says to qualify for a K4 the child must be a applicqnt of a K3 holder.

No, for a K-4 you need the I-129F approved. The I-130 is for a CR/IR visa

I would get in touch with a Congressman or Senator from the state where you have family ties to, and consider an immigration attorney as well.

I-130 Received Date per letter Feb 22, 2010

I-130 NOA1 Notice Date per letter Feb 28, 2010

I-130 Touched March 2, 2010

I-130 Touched March 23, 2010 no e-mail despite e-mail alert on, thankful nonetheless!

Kids Register of Birth Abroad & passport appointment March 31st, 2010 approved.

I-129F NOA1 April 8, 2010 (Let's see what happens with this K3 application) ugh!

I-129F Touched June 15, 2010

I-129F RFE (our atty forgot to complete 2 lines)

I-130 Approved June 23, 2010 121 days from NOA1

I-129F RFE details Received by USCIS July 7, 2010

I-130 Case # at NVC obtained July 8, 2010

I-130 NVC sent affidavit of support and visa bills July 8, 2010

I-129F approved by USCIS and sent to NVC

I-129F confirmed received by NVC and per supervisor, it will be administratively closed

I-129F letter recvd of administratively closed K3 app Aug 2, 2010

All of that already covered, way back when.

FWIW - the child of a CR-1 visa holder has no derivative status, so hoping for a K-4 (which is a derivative of a K-3) is useless for him.

It's interesting, a path was mapped out for him, he still chose to ask, 2 months later, about a K-4.

Why? He failed to file a 2nd I-130 on the child. One avenue available to him, always, has been to file a 2nd I-130 for the child.

06/01/11 - Submitted change of address online to USCIS. Mailed I-865 for sponsor. Neverending!

10/07/12 - Sent I-751

13/07/12 - I-751 NOA1

This is not a K visa case and never has been, so K4 is out of the question, and "follow to join" is not an option. The OP has been told already some time ago that he needs to file an I-130 for the child. Why he's back asking questions he already has answers to is a mystery.
