Ok, I have one more question about i-864 like I said before I am using a sponser for my husband because I did not make the income req. Well my question is that you are supose to send a copy of your most recent well I have filed my taxes for 1009 and have my return where my soponser owns his own business and will now have his file until April. Will I have to wait to get his back before we can file AOS or can I send my sponser tax return for the most recent I he has now which is 2008?

Send in what you have now. Worst case is they wait until after April 15 to begin to adjucate your application and send an RFE for that for your cosponsor. Have a copy ready and fire off the form if they ask for it and you're good to go. They also may not ask for it and therefore you are good to go. I would not wait. Ididn't for our AOS and nothing yet but have since filed my 2009 taxes and can send a copy if they want.

A tax return from 1000 years ago won't work... not to mention that the US was not even a country then... :)

I've read USCIS memorandum that explains that it's the latest tax return as of the date that the I-864 is signed. Until April 15 of 2010, the latest tax return in 2008. After that it's 2009. It's okay if you have 2009 done before the deadline, but you don't have to have anything but 2008 right now. Even if they don't get around to adjudicating your case until June 2010, if your sponsor signed the I-864 prior to April 15, then they evaluate with the 2008 return. If they have reason to believe that some significant change has happened "other than the passage of time" (their words) then they can ask to see a later return.
