Timeline

my husband wants to claim me on his taxes. the problem is i dont have a social security number yet because we just filed for the adjustment of status. the social security agent said we can go to the homeland security and ask them to extend my I-94 which has expired on august so that we can apply for a social security number. :unsure::unsure::unsure::unsure:

do you have any idea? :wacko:

I-94's for K-1's are NOT extendable..

you can apply for and get an ITIN by submitting a W-7 with the return

Two options -

1) File your taxes with a W-7 application for an ITIN as suggested. The ITIN will take 6 to 10 weeks, then another 6 to 8 weeks to process your return (ours actually took about four months from filing to refund).

or;

2) File for an extension on filing. This will give you and your spouse until 10/15/2010 to file your taxes. When you get your EAD (in April based on timeline) go get your SSN. You should have your SSN by the end of April/early May, at which point you and your husband can file electronically and get your refund back in May. If you filed today for a W-7 you would most likely be mid-summer before your return was processed and any refund sent to you.

If you and your spouse are paying taxes instead of getting a refund, option 1) would be my choice (takes them longer to process and cash your check).

09/20/2007 - Sent Packet 3 for K-4 Visas (follow to join for children)

10/02/2007 - K-4 Interviews - approved

10/12/2007 - Everyone back to USA!

AOS

06/20/2008 - Mailed I-485, I-765 (plus I-130 for children)

06/27/2008 - NOA1 for I-485, I-765, and I-130s

07/16/2008 - Biometrics appointment

08/28/2008 - EAD cards received

11/20/2008 - AOS Interviews - approved

Citizenship

08/22/2011 - Mailed N-400
