Am I eligible to receive Unemployed Insurance?

Timeline

Hello everyone. I am working as E2 visa since Sep. 2006 and I filled AOS last month.

My company told me that they will lay me off on March 31st 2010. :crying:

I can legally stay here since I am AOS status right now but

I was not sure if I could receive Unemployed Insurance during unemployment.

Do you know anyone if I can receive it or not?

if you are eligible (each states eligibility is different), you can collect without issue

Forgive my ignorance but don't you have to be an LPR for a certain amount of time first?

UI is a state administered program so there are 50 potential different eligibility requirement definitions....

I quickly reviewed the MN UI law and could not see where being a Citizen or LPR were required to collect. What I could find is that an covered employee is anyone who has performed employment type work for an employer (fairly broad statement)

The OP simply needs to go to the UI website for there state or go to a local office and apply for benefits and wait for a determination... Collecting UI will have zero effect on any immigration benefits applied for now or in the future

Well, in Michigan UIA website, it says that:

If you are not a citizen or national of the United States, you will need your Alien Registration Number and the expiration date of your work authorization.

I do not have it since I just applied AOS last month.

I talked to the support desk but she was not sure if I am eligible or not. :wacko:

I think I am just going to apply it and they willl let me know if they would accept my application or not....

I bet you do have an "A" number... check your NOA for AOS... it might just be there...

I checked my NOA for I-485. In a Applicant column. You are right. I saw "A" number. Is that going to be my Alien Number to use? Wow, that is great things to know. Thank you! :dance:

The first question is were you or your employer paying into the insurance ? Not everyone does and if there is no money going in you can't get any out.

Well, I thought this will be paid by State or Government.

I looked up Unemployed Insurance Agency website and I though I was qualified to receive it except Alien Registration # part.

Check to see if your employer offers has been paying unemployment insurance. It varies by company, but coming layoff time HR should sit down with you or sometimes in group to go over some of the papework, including information about COBRA, unemployment and any other questions you might have, so to be pro active since they have already mentioned the impending layoff, it's a good question to ask them if you are covered, they will know if they have been paying unemployment insurance for you.

So, go file. Then you'll know, and you'll learn WHY you are not eligible, or that you ARE eligible.

My understanding is that in general, if I loose a job, I need to leave USA since I am working under E2 VISA which means that I will not receive UI in ths USA.

One of my friends who was Japanese citizen lost his job and he left USA and applied for UI but he could not receive UI.

Well, my sisuation is different from him so I am just going to try and see if I receive it or not them.

I called Unemployment Insurance Agency in Michigan and I told my Axxxxx # which showed in my NOA and I just received a letter that I will be eligible to receive Unemployment Insurance!!

If I were Visa holder, I would be able to receive benefit but now I can. :yes:
