MY CSPA GOOD OR BAD ENDING?

I just want to share you guys my experience regarding my CSPA. Right now i don't know what will happen well hopefully its a happy ending.

Here are my details

registered nurse in ph

24 years old

PD 1984, may

Birthday february 4 1986

others to follow...

together with me applying for CSPA are my brother 26 years old and my sister 27 years old

Here is our story its kinda long but for the people out there who is same case with us (CSPA) and Humanitarian Revalidation feel free to read.

Well supposed to be i am in the states today the problem is when i was 20 years old the petitioner died and after 3 months after his death our petition arrived. Death= automatic revocation of petition. So my family had quit the petition thing and had move on with our dear lives. My mother then came across with humanitarian revalidation in which a lawyer is needed. My mother typed humanitarian revalidation for ph and the name Atty. Eugene Palacios came. Well she hired him and paid him around $10,000for my mom and my dad and for the 3 of us $12,000. Luckily the Humanitarian revalidation was approved and my mom and dad got their immigrant visa.

Now the problem is us. For our CSPA according to our lawyer's computation our CSPA are all below 21 years so we are very much applicable for the CSPA. So what happened here is during my mom's interview with the consul after him saying that "the immigrant visa has been approved" she asked regarding our case and what the consul told her is pass your application and we well review it. The lawyer then told us to pay for the 400$ per head for application which we did yesterday. So yesterday we went to us embassy present the letter of the lawyer so that the guard will allow us to enter the us immigration. Inside we went to window X and was given this piece of paper regarding all the requirement we also signed a lot of things after that we went to this window 24 and told us that the 400$ is non refundable and said good luck. The 3 of us cost around 55,000 pesos which is a big waste if our case will not be approved.

After that we were fingerprint and then the interview. During the interview the American consul ask our age, approval date, priority date, and our birthday. The consul then checks and was asking the people inside how did they get the computation on our CSPA we then hear him saying i don't want their mother crying over which is an indication that we didn't pass the CSPA. He then again talked to us and said i am sorry but your cspa doesn't qualify. My mom then gave the consul the lawyer's own computation which he reads for a long time. He called to washington asking about it and said if we can wait for 20 minutes and if no news was heard we will be informed via mail. He then ask us to go outside and will be called shortly for information. The consul also said this "I will review your case carefully because what will happen here will make a big impact with your life" this show how nice the consul is. So we went outside and was called in window 24 to our shock the women there told us that we didn't qualify and gave us this peace of letter saying didn't qualify on CSPA. She said they have their own computation and blah blah blah... her voice was so loud that people behind us heard everything which was very embarrassing. We went home all with bad mood i went to the gym and later noticed i have 3 miss call with different numbers. When i went home around 3 my sister said that she was called by the US Embassy and said they had a mistake and that our case is on going and that we will be informed if we are qualified or not qualified on CSPA

That's about it well ill just post updates well hopefully we will be approved. If my mom didn't present the layers computation and letter our case is over but luckily she gave him the computation and was given a chance maybe 40-60 i dunno haha please pray for me.

we have the same case, but not it CSPA, petitioner dies..

my Grandmom petitioned my dad back in 1993 under f3. unfortunately, my grandma died last year, and feb2010 we got the approval of the petition. leme ask, how much your mom paid for the lawyer for humanitarian reinstatement??? dollars or in peso? we were in process of making a humanitarian reinstatement. we dont know to hire or not to hire a lawyer for this. HOW LONG DOES IT TAKE FOR the APPROVAL OF HUMANITARIAN REINSTATEMENT?

Hi! Well my mom paid 10,000 dollars(for 2 people my mom and dad) to our lawyer Atty. Eugene Palacios i can really refer him to you because he was able to win our case (humanitarian revalidation) (CSPA not yet but hopefully he will haha) I think your case will be easy as long as you will be able to complete the requirements affidavit of support etc.

I am not really sure about the length but i think in our case it took us months-years but i think on your case it will be easy but you should wait and its possible by the time your petition is re-validated you'll be 21 so CSPA is possible to you so pray for me because we will have same case haha. I will ask my mom so that i can give details to you.

WOW!! thats alotta money!! 10k dollars. we dont have that. HAHA. what did the lawyer do? does he serve as an agent as well? we inquired in an agency here, he said 70,000 pesos for everything. he will also serve as the agent. 70000 is alot money. my aunt have a friend with the same case as ours, they didnt use a lawyer. what my aunt will do is that she, as a substitute sponsor, she will be the one who will send the humanitarian reinstatement letter. as per your case, its ur mom who did it right?

how come youre saying that in our case it would be easy? well i have a sister who is turning 23 this year, so CSPA will be applied to her on a later date. haha! so goodluck dude!! and keep me posted. please post abt the details on humanitarian reinstatement.

anyhow, CSPA article is pinned above, it might help you.. i have read some cases abt CSPA, they didnt use a lawyer..

Well the lawyer sends a letter to the embassy regarding the case he also taught my mom what was needed. Im not really sure about the details. Im not sure if he is an agent but he is a lawyer in the states. So what happened to your aunts friend was it approved? Yup we had a substitute sponsor too which is my moms sister who also provided the affidavit of support.

Im saying this because its the same as our case i mean its been tried and tested because humanitarian revalidation also worked on our case. If your case will be approved your sister will surely need the CSPA. Ill post something about the reinstatement when i got home ill ask my mom first.

Right now i am no longer expecting anything because if you read my story we have been denied already last march 8 but after a few hours the us embassy called saying that they made a mistake that our case is still on going that's why i am no longer expecting anything. What will happen to me if approved ty if not approved its ok ill just have to work hard or get an american citizen as fixed hahaha easier said than done

what my aunt's friend did was the friend send a humanitarian reinstatement letter to nvc and that she's willing to be the substitute sponsor etc attached are the documents like aos. yea they got approved. they are now in the US, mu aunt will do the same. i just dont know the timeframe for that. im wishing that it will get approved atleast 6mos before i turn 21. haha.

well u should expect for it, call or email us embassy. it might help with your case. what is your cspa age by the way? yea nurses like you are highest paid job ever in the united states. here, most of you are jobless :D go and marry usc! haha.

Ah ok and i forgot to mention pala ung new law sa Humanitarian Revalidation na madali ng ma process ung case nyo kaya i guess no need na mag lawyer pero kung ma disapprove kayo(which wont happen hehe) i think its time to hire a lawyer para cya makikipag argue bout your case ganun nalang gawin nyo.

Mag wait nalang ako pero nakakabadtrip lang talaga everytime na uuwi ka sasabihin mo ma balita sa petition haha lagi ganun and basa ng basa ako sa net about sa mga cases. Regarding sa CSPA ko kung base sa calculator na makikita sa thread na ito nasa 20 pero d pa kami sure kung tama b ung mga nilalagay namin kasi ung sa ginawang computation ng lawyer namin (negative) -1.72 kakaiba cya talaga ewan ko kung bakit ganun ung computation nya pero base ito sa mga batas na may freeze freeze pa sory i cant eleborate masyado ksi kahit ako di ko naiintindihan. Marami na cyang pinaalis na CSPA case malamang ganun din computations nya. Pwede ba kaw nalang marry ko pag na ok petition mo mabait akong husband wahaha lol joke lang.

wow. true? san mo nakita yang new law na yan? super research din kaya ako abt our case.. kaasar. naudlot nanaman kasi excitement ko.. so ironic, naeexcite ka, tapos pagdating mo dun, jobless ka, ewan. :D kaasar kasi bakit pa sila magrerevoke ng petition kung may magffile naman ng aos. have u asked ur mom kung how long does it take sa approval ng reinstatement?

ay naku, wag ka lang magwait noh, u should make a move, dapat kulitin mo yung embassy abt sa case mo. di kaya biro ang 400$! lols. kaya yan. makakaalis ka din. mauunahan mo pa ko, haha. :D well ur a nurse naman pagdating mo dun, so y not marry you. bwahahaha!!! joke. :D keep believing ;) God is with us.. hopefully this year!

thats from president obama cya nag pass ng law na yan. Ask ko si mama kahapon gulo ng sagot e nagtratravian kasi pero it took us months-year siguro give yourself 6months-1year depende kasi din un kasi samin may lawyer baka kaya ganun kabilis pero im not really sure din ha.

Well hayaan mo sila haha saka sila nanaman tumawag samin na nagkamali ang us embassy na hindi kami disqualify sa cspa kaya hintay nalang ako wait daw kasi namin ung sulat. Oo nga naawa nga me sa mom ko kasi $1200 ung binayad saming 3 application fee +$12,000 sa lawyer kaya di talga biro haha. Haha natawa ako dun ha kung magiging AC ka might as well as get a nurse with NCLEX na para cya namagtratrabaho buhay kana hehe. Hopefully bago mag june may balita na gusto ko na talaga makabalik sa states.

my understanding on that link is that u need to be in the united states for the adjustment of the status. idk.anyhow, tell me abt the update of your case. my aunt is gonna be here by monday. not yet sending the humanitarian reinstatement. juskooo. kelan kaya masesenddddd haha ;)

have u took nclex yet? or just nle?

oh please ask ur mom on the timeframe. visa bulletin didnt move this april. sooo disappointed. :(

Yes, it was in san francicsco daly city i was grade one(elementary) and now im 24 haha a very very long time. Im from cavite city what about you? Nope i havent taken the nclex yet but i will if our petition will be ok maybe ill resign immediately from work and then take the NCLEX. Yes im registered here in ph.

regarding your visa bulletin have patience it will moved soon haha right now just focus on your studies. Where do you study and what course? nursing too? Good luck criss

hopefully yea, get in there before i turn 21. and HOPEFULLY wont use CSPA :D ur mom and dad is in the US now right? yes please do ask ur mom for the timeframe, i have read that upon receiving in the USCIS, it will took them 30 working days, i dont know, maybe true.. im here in manila, electronics engineering in adamson. 4th year. haha. so ur working in a hospital? a friend of ours just said that nursing has no place in the us right now. lol too many nurses in the us now. well then, goodluck on us. see ya in the states. LOL :D
