I-94 Card Issue PLEASE HELP

Hello Everyone,

My wife and I had completed the whole K-1 process and we arrived together at Dulles International Airport in January of 2010 (I went to pick her up from Bosnia). Currently we are working on the AOS packet, but when we went to apply for her SSN we found out then that on her I-94 card she (my wife) wrote her last name but placing two letters in one box. This is what happened her maiden last name is Maljic and she put "L" and "J" in one box. When we went to the SSN office her name in the "system" was Mayic which is not correct. When we applied for her SSN her name was reflective of the wrong spelling. Our problem is not with the SSN rather with the AOS packet since we will be sending a copy of the I-94 card with this. We have been going back and forth with the CBP, Homeland Security, and USCIS and no one has been able to help us out. From our last conversation with the USCIS office the lady advised that we go on the website www.uscis.gov (I bet you hate seeing this link heheh) and request under "INFOPASS" to make an Appointment with our local officer. Honestly we have thought about sending it as it is but did not want to take a chance of it being rejected or being wrong and delaying the process. We need to act FAST since we have to send this out by April 23, 2010. We have not been able to find someone who can access the USCIS system and tell us yes or no if this is wrong in their system or not or if this will reject our application.

I had a somewhat similar situation as you. My stepdaughter visited us last year. When she filled out the I-94 card on the flight, she mistakenly entered her DOB incorrectly (she placed 06/01/95 instead of 01/06/95). We didn't realize this until two weeks later!

First, we searched Google for solutions. All of them said to call your nearest Customs and Borders Protection office. Specifically, to call the office that has jurisdiction on your point of entry (POE). This is what we did. The customs officer asked us what was the problem. We explained that it was a mistake on the I-94 card. He gave us an appointment the following morning.

When we went the next morning, he asked to see my stepdaughter's I-94 AND passport...as well as my wife's I-94 AND passport. He then issued another I-94 card and had my stepdaughter complete it accurately. We were there around 10 minutes.

We did not need an INFOPASS appointment. Perhaps we were lucky. But I would suggest you try calling the CBP office that has jurisdiction on your point of entry.

We actually have already contacted CBP but once we started talking about the K-1 visa they told us that they only issue the physical cards and do not make changes to the system. Also our POI was Dulles International which is about 2 hours away from our house. Their only appointment times are 10 am - 2 pm Monday-Thursday. Although it is far and it would cause small problems for us to get up there it is not impossible if this is our only chance.

My main concern is really how IMPORTANT is that I-94 card and the spelling of the name since her name if you look it at is spelled correctly "MALJIC" its just that L and J are in the same box. If we send it up to Chicago (or wherever it goes now) are they really going to look at this detail?

Would it be possible to make the correction on the I-94 card (via CBP offce), then present the corrected I-94 to Social Security? It will be corrected in the federal system then. I understand that it may be such a hassle for you to make an appointment, then travel 2 hours. But believe me, it'll be worth it in the long run.

You must remember that the spelling of one's name, date of birth, etc...are very important to the federal government. Yes, they will look at every little detail. If your wife also has birth certificate and passport with maiden name of Maljic, but on a federal background check says Mayic, this will pose a problem and will cause delay.

I'm sorry to tell you bad news, but this should be fixed before adjusting status. I assure you it'll be a much smoother process fixing this first.

Please instruct the applicant to go to the local Deferred Inspections Office, located in the airport, and bring documentation showing their correct name. The applicant will also be required to speak with an Inspector to ensure the information will be updated in the DHS databases.

Hello Everyone,

Ok we had some amazing luck. Before we called the CBP to make an appointment or see what to do further, I did some reserach online and found that any airport that has a Homeland Security office can change and fix your I-94 card it does not have to be your POE airport which meant that we did not have to drive 2 hours to DC. So I called CBP main line and asked them this, they gave me a direct number to Richmond International airport (since I could not find this number ANYWHERE online) and in two minutes I had set up an appointment for us to get her I-94 changed. We went to the airport and this took about 15 min, they were really nice and explained the whole issue, also the officer at Dulles at our POE put in her info. in the system wrong PLEASE BE CAREFULL AND CHECK ALL OF YOUR DATES WITH THEM, if we waited any longer to fix this issue we could have had a expiration problem. So in the end everything worked out really well, we are ready to complete our AOS packett and get it send out.
