You don't need to live in the same household to file jointly.

Ok - do you know what the paramters are re joint or single?

When I'm ready to do my taxes I'm meeting with my accountant up here because there are many questions and issues ie RRSPs and keeping them in Canada. They are a creature of the Canadian system and will be respected by the USA unless you take the money. There is an annual form to be completed with US taxes to ensure the RRSP money doesn't get taxed. There's also issues re can you keep Canadian stocks of you are a non resident, and some banks allow you to have non resident status and others don't. Plus the filing in both countries issue. I know there are tax treaties between Canada and the USA. It's a tad complicated as sometimes taxes can be but...

Ummm... no. I've been here since Sept, married since Nov and there was absolutely no issue with adding me to his taxes.

Have a read, we only need to have been married for ONE DAY in the last tax year to qualify as "married" for the IRS...

To the OP read here: http://www.irs.gov/publications/p501/ar02....blink1000220722 specifically: "Married persons living apart. If you live apart from your spouse and meet certain tests, you may be considered unmarried. If this applies to you, you can file as head of household even though you are not divorced or legally separated. If you qualify to file as head of household instead of as married filing separately, your standard deduction will be higher. Also, your tax may be lower, and you may be able to claim the earned income credit. See Head of Household , later."

It's the dependent status I was referring to mostly. Someone cannot be a dependant for just "one" day.

Are you speaking of Canadian or American taxes? You can't file as single in the US once you are married.

Regards to stocks:if they are mutual funds ,you can not transfer it to US.You can keep them in Canada,but don't forget ,you will have to pay 25% non-resident taxes in Ca

If you have stocks with a trading company:You have two choices:You can transfer them to a US Brokarage firm as is.so u don't need to sell anything.thats what I will be doing soon...OR you sell all your stocks ,take the money to the US and make any investment you'd like...You can also leave them here with ur trading company,but you have to talk to them and clarify this since not all of them like this solution

Unless you're physically living here 6 months out of the last year, he cannot file as 'married' and claim you in any way as a dependant.

Now, a good tax attorney might find a way around this possibly, but without proof of you living here and without an SSN it's not really possible.

Filing single is his best bet/probably only option.

The "married" option only really works any way if you were filing your taxes together. You can still file 'single'/seperately even if you were living here...

Not true either - we were married in November of the year I moved here and we filed married for that year which was acceptable - there are exceptions

filling as "married filing seperately" still asks for my SSN,tax etc... which I don't have any of them

hello

when i called the IRS they sold me

my Husband USC has to claim married what ever his status was Dec. 31 2009 is what he must claim

there are different options under married

which one suits you best

i was told he can file as

married filing seperately

he can claim myself as well as my 2 children

he did support us even though i never lived in usa

now once he does his income tax to get numbers on income

he then can file for extension (still have to pay by april 15)

but the actual hard copy is not mailed my husband will have until october to mail in hard copy of income tax

by that time i will hopefully be living in USA as my interview is April 22

then when i get my SSN iwill write on his income tax and mail it away.

this is the info i received when i called the IRS.
