My husband was adopted when he was 5 months old. We have the adoption papers,and will be sending them in to compensate for his birth certificate not having his parents name on it. Do we need to put the name listed on adoption record on DS-230 under "other names used/aliases"?

I would. Especially because you have the paper trail (adoption certificate/decree) to prove it.

In fact, I did.

My husband was born with one name, Kasem. His parents changed it when he was 6 weeks old. On his birth certificate, Kasem was crossed out and his new name, Apirak, was written in above. That's it. No name change certificate. Nothing. He has no papers, school documents, anything at all other than his birth certificate stating his name as Kasem. He's never answered to that name. Nothing at all. But we still put it on his I-130, G-325A, DS-230 and police certificate application where it asked for previous names. Heaven forbid they issue an RFE or consider it to be misrepresentation or that he has some other hiden identity. No, Ma'am.

I don't know how Canadian legal documents work, but I would still send it in and request a duplicate from the issuing court or other provincial authorities.

Is your husband the one from Canada? I was adopted in Canada, at 2 years old. I applied for my long BC in Sask. While the birth registration is dated in the year of my adoption, and has my adopted parents names on it, I got an accompanied letter from Vital Statistics, indicating that I was adopted, hence the birth parents names have been changed to reflect the adoption. I never used my birth name on anything, nor should you be doing so. It's not a name he uses is it? Use the adoption papers to get his BC if that's what you need, I didn't, but at no time, in paperwork for immigration should you be using his birth name.

Of course if I confused you because I was born and adopted in Canada, I'm sorry. Have you tried to apply for his BC in the UK? As I indicated above, my long form BC in Canada was changed to reflect my adoptive name, so this wasn't an issue for me. I don't know what the BC system is like in the U.K. His adoptive parents must have a BC for him do they not? In his adoptive name? How else could he have applied for a SIN number, or DL when they require a BC, and in the name of which he now goes by?

His police certificate should only have names he USES. There is not going to be any police record of anyone that had a name that was changed when he was 5 months old. The search is for other names he's used.

Personally, I think you're just causing more grief for yourself when you're talking about different names, especially to government officials. I'd go the route for a BC firstly. When my parents adopted me, the birth was "re-registered" with my adoptive name. See if they do this in the U.K.

im adopted and it was explained to me that the name given before the adoption has no barring on the application because it is not a name that i have used................so i just gave my birth certificate and passport copy

Thanks for the input Sara, you have confirmed I was right (hand hubby was not!). I agree with you, Carla, about adding other names. Stubborn man wouldn't listen to me about that. He has already requested the police certificates with the birth name on it (In addition his legal name), so I will just add an amendment stating why it is on there. *sigh* He has a birth certificate, but it is a 'short form'. I think we can use that, since we do have the adoption decree and the baptismal records.
