IM Evewila, I have a 1 year old son and his father US citizen..I gave birth to him here in philippines his father was here that time and his the one who sign the birth certificate of my son, and My sons used the surname of his father even we are not married yet but we signed at the back of the Birth Certificate certifies that we are not married yet at the time of birth..I didn't report or apply CRBA for my son..

AND now my fiance will going to bring us to the US, file petition and now I am worried if we will encounter problem later on with my sons status or his illegibility

MY questions are:

-Can I apply fOr his CRBA and US passport later at US?

-Does he need passport to travel with me?

-will the the embassy ask why he used the Surname of his father even we are not yet

married or questioning about his illegibility?

PLEAS TELL ME WHAT ARE THE THINGS TO GET DONE BEFORE HE FILE THE PETITION..PLEASE HELPS US!...

Your son will need a US Passport before traveling to the USA. His father must be involved in filing the CRBA.

Thank you!

does it means he cant travel to US wIthout US passport?

Since he has a Philippine birth certificate, you could probably get him a Philippine passport. However, he couldn't travel to the US with a Philippine passport unless he had a visa. The US consulate would probably not issue a visa for him because he has a claim to US citizenship. You should file the CRBA and get him a US passport.

The process for reporting the birth of a US citizen at the embassy in Manila is described here:

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
