Filed an I-90 instead of an I-751

Timeline

I have a friend who was supposed to file an I-751 for the removal of the conditions in her residence status, but instead she accidentally filed I-90. USCIS sent a letter telling her that it was the wrong form to file. Since it was still within the allowed period to file the I-751, she did so.

Meantime, USCIS gave her extension of 1 year which will expire this coming December. She did not receive any notice yet for her biometrics and she is worried. Any ideas on this matter?

You are in the correct forum.

When did your friend file the I-751 and what is the date on your extension letter, also known as the Notice of Action (NOA)?

08/08/11 .. Received text/e-mail: Placed in line for interview scheduling

09/12/11 .. Received Yellow letter dated 9/7/11

09/13/11 .. Received text/e-mail: Interview scheduled

09/16/11 .. Received interview letter

10/19/11 .. Interview - PASSED

10/20/11 .. Received text/email: Oath scheduled

10/22/11 .. Received OATH letter

11/09/11 .. Oath ceremony

Timeline

Hi, just to follow up with an old thread, my friend filed her 751 back in January, and she still has not received her biometrics appointment. She is starting to panic, and isn't getting through to the USCIS when she calls. Is there a backlog? What's could be going on?

Five months seems to be a bit long already. Not totally unheard of, but long.

Problem is, technically she's expected to wait patiently until the 1-year extension of her Green Card is about to expire. If she calls them, she most likely will get to hear only nonsense.

Here is what I would do. I'd call USCIS and politely demand to speak with an Immigration Officer. Try to find out if the Biometrics letter has been sent (mailed) to her or not. That alone oftentimes gets the ball in motion again.

I had the same hiccup, was the second to last in my 'group' of ROC applicants, called, spoke to an I.O. who told me it takes up to a year to process . . . and got the letter a few days later.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . .
