Help - my file might've been lost

I applied for AOS from a K-1 visa in July, got an interview notice in November and a cancellation notice few days after. My case is way out of normal processing times now, and today I had another infopass appointment trying to find out what was wrong with it.

The IO said that as far as she can see there is nothing wrong with my case, except the little detail that my file isn't there yet and that's why interview was cancelled. She also said she didn't know if the problem was with my K-1 file or the AOS itself (which I'm not sure if it's true or she was just trying to be vague), but since it's been 4 months now I am getting quite worried. Could have they lost the file? The soft LUD on my case is December 1st which is a while ago :/

Does anyone have suggestions about what I could actually do about it? The IO said I just have to wait until they send me a notice, but I obviously don't feel very comfortable waiting doing nothing.

Contact your congressman to get the right information for you. You obviously did everything possible to follow up on it.

Since you are out of the normal processing time, I believe you can call the 1-800 number on your NOA and get that person put in a service request.

02.22.10 - RFE for Medical (dated 2.18.10)

02.23.10 - Infopass (not helpful)

02.26.10 - Sent reply to RFE for I 693 to Lee's Summit and sent letter to senator (day 18)

03.01.10 - Delivery confirmation for RFE by Lee's summit and senator

03.04.10 - Status update: Case has resumed; letter from senator stating case is with adjunctor(day 24 )

03.08.10 - AOS application transferred to CALIFORNIA SERVICE CENTER... No updates on EAD or AP (day 28)

03.13.10 - touch on 485/ 3.15.10 - touch on 485/ 3.16.10 - touch on 485/ 3.17.10 - touch on 485!!! (day 37)

03.29.10 - Day 49 from notice date of NOA.... day 58 from filing

04.06.10 - AP approved and EAD card production ordered!!! (Day 56)

04.08.10 - touch on AP...... 04.09.10- touch on EAD (second card production notice) and AOS

04.10.10 - AP arrived in the mail

04.13.10 - EAD approval notice online and card in the mail

07.10.10 - A TOUCH!!! (on AOS)

08.06.10 - Another touch

08.17.10- AOS approved!

Contact your congressman to get the right information for you. You obviously did everything possible to follow up on it.

Thank you for the suggestion :) I'll contact him ASAP, hope I can find out what exactly is going on with my paperwork.

Thank you for answering. I already filed a service request through customer service, and they sent me a reply through mail saying that my case is actively being processed and to contact them back if I don't hear from them in 6 (!) months. So I've kind of given up on customer service...

I don't know why you keep asking the same question over and over when you didn't bother to try what other people suggested you to do. I already took my time to tell you what I did and explained what you should do . Don't ask for advice if you don't really need it.

I don't know why you keep asking the same question over and over when you didn't bother to try what other people suggested you to do. I already took my time to tell you what I did and explained what you should do . Don't ask for advice if you don't really need it.

I'm posting again because I *finally* got an answer about what was wrong with my case, and I got it this morning as I wrote - they said they are still waiting for my files so the problem is that the files are missing. I'm hoping to hear from someone who had a similar problem.

And by the way I called and asked where my petition is, and asked the same to the IO today, and they said it's at NBC (which doesn't have an email address on the link you gave). Moreover, it says to contact them only if I didn't receive an answer from my inquiry to the customer service, which I DID receive, just it didn't really tell me anything useful. I understand it worked in your case, but our situations are different. Why don't you try to actually read what the problem is before reacting like that :(

Anyway I decided to go for the congressman like milimelo suggested. Seems like the best option at the moment.

The customer service representatives always give you answers even if they just say it's raining outside or that you have to wait another year that doesn't mean you should wait forever...and you can e-mail to the address not linked to any service center. And by the way you got the suggestion to contact the congressman on your previous post.

And you should realize that most of cases are preatty simple and not to many have bad experiences like us and you should try to appreciate the answers that you get.

You think that you posted a different question but in fact is the same one. You are trying to get in touch with people other than customer service representatives who can give you answers.

Anyway good luck and I wasn't rude you were. I wish that someone would have given me the info that I gave you but nobody took the time to do that even if they knew.
