Working during K1 visa application

Hi,

I'm new to the forum, and my USC fiance has recently filed our K1 petition (last month). I have since been talking to potential employers in the US and was wondering what my options are for working.

I know that right now I cannot work legally in the US. I also know that I need the fiance visa before I can apply for the work permit/green card. However, does anyone know if it is possible to have a US employer sponsor me for a work visa (H1B) while my K1 visa goes ahead? Or would that just cancel out my K1 visa?

I'd be grateful for any advice!

Thanks

Work authorization requires the K1 visa followed by marriage in the USA, then application to adjust status and to obtain employment authorization. Not sure on the simultaneous visa processes but if you obtain an H1B visa, you do not need a K1.

When you're talking with potential employers, keep in mind it will likely be another 5-6 months until you live in the US. After that, you will have 90 days to get married and file "Adjustment of States" (includes an application for work authorization). After THAT is approved (it can take 3-4 months), you'll be eligible to work. So if you just filed your K1 last month- you are looking at a possible 10-12 month wait until you'll even be authorized to work in the US.

An H1B might be a good idea if you have an employer ready to sponsor it. However, if you ever lost your job or wanted to move you'd have to still go another visa route to stay permanently. But if you do have the chance to do this, it would be great because you can see your fiancee sooner :)

I don't know what the rules are about processing them concurrently.

Good luck!
