T4 - former canadian employer refusing to send it.

Soo tax time is coming and my husband has already started to file his taxes.

As the title states... My former employer from canada is being a total ######, shes skirting my phone calls pretending shes not in the store. She is avoding family members that have gone in and asked to have my T4 mailed or sent to the store to be picked up. The employees have claimed on 3 different occasions that " it should have been sent check your mail " we have been doing so since the beginning of febuary and nothing has come. Friends that I worked with their already got their T4 at the beginning of febuary. They have my address and information and all that.

I have got my T3 ages ago in the mail. All I need is my damn T4. Does anyone have a number at the CRA I can call and request a fax or copy of my T4 ( if the employer even sent it to CRA ) What all can I do about this aside from what im already doing to try to get it?

Nothing really, however you should send your former employer a letter, so you have documented proof that you have requested it. You can file your Canadian taxes without it, just attach a note and a copy of your last payslip - to support the numbers you are filing with.

Information slips

Information slips (T4 and more) Slips are prepared by your employer, payer, or administrator and must be issued on or before the last day of February following the calendar year to which the slips apply (except for T3 slips, which must be issued no later than 90 days after the end of the estate's or trust's tax year, and NR4 slips, which should be issued no later than March 31 following the calendar year to which the slips apply).

If you have not received, or have lost or misplaced your current year's T4 slip, or other information slip, you have to ask your employer, or the issuer of the slip, for a copy.

On the other hand, if you are filing a tax return for a prior year, and you have not received, or have lost or misplaced your information slips for that year, you can call 1-800-959-8281 for a copy of your slips for that year.

Note

If you know that you will not receive your slip by the filing due date, attach a note to your paper return stating the payer's name and address, the type of income involved, and what you are doing to get the slip. Use any stubs or statements you may have to calculate the income you have to report and any related deductions and credits you can claim. Attach the stubs or statements to your paper return. If you are filing electronically, keep all of your documents in case we ask to see them.

I dont have any paystubs, we didnt get any as it was all automatic payments. Which causes further problems because my bank account is closed and I have no paper evidence because of course my banking was all online! Greeeaaaat lol.

Don't I need T4 to file with my husband since we have to claim all the canadian $ on the american taxes? ( If we file jointly ) and If we don't file jointly dont I need to file american tax anyway to claim my canadian income?

Im almost certain I didnt make enough to " file " in canada as I only worked a few months before quiting to move to america. ( yes I know file anyways even if you dont owe anything and they owe you )

Yes, CRA probably owes you money, so no, you probably don't have to file if you don't want a refund.

As for the U.S. taxes, I can only tell you what we did and that was to send my Husband's T4s - as well as his W2s. I assume you are using tax software. Work both scenarios - try filing a joint return and see if the deductions are higher, therefore your Husband gets more of a refund. Then try him filing married filing separately. If there is no difference and you made less than around $3000 U.S. for the year (check the exact amount on the instructions for the 1040) - then you don't have to bother filing U.S. taxes either.

But, it's all kind of a moot point if you can't get your T4 and you have no proof.

I don't know which province you are from, but in most, probably all, an employer is required to give you a payslip. He/she sounds like a real gem.

Regardless, I would still contact CRA and give the employer's information and explain your situation to them.

I may be wrong, but they are legally obligated to send you your T4 at least to your former address, if not the enw one if you have provided it to them. You could try the CRA # and find out if they have a department for deliquent employers.

I still dont have any of my tax slips. legally they had til feb 28th to send them out. from what i noticed with my mail it takes a minimum 2 weeks usually for the redirect to actually get to me in chicago, and i'd like my rax refund :)

My mail is not redirected it goes directly to my mom and she forwards or fax's me important things, Mail in ontario takes about 1 week. My place of work is not far from where I lived. Im Def going to call CRA today and report this or whatever I can do about it. - I believe they are legally obligated to send it out.

Yep my former employer was a real gem, lots of underhanded things went on at that retail store. They even hid things from the mall police that happend when in the hand book it said to report everything.

Ill post the results on here after I call CRA and such incase anyone else finds themselfs in this situation but I would certainly hope that no ones employer is as bad as mine was. Eg- she would hide in the bathroom to avoid speaking to customers who were looking to rectify a sale.

Heyy Inky! I heard you and your husband bought a house? Is that true? :)

I had some issues with my last Canadian employer as well. Thankfully after sending my dad down there a few times she finally agreed to give it to him last week. He's a big guy, I wouldn't argue with him either :lol:

Yes we did! we were living in base houseing and it was HORRIBLE conditions!! One of my husbands best friends was selling his home so we went and had a look at it and 4 days later they accepted the offer and we were at the table signing away our lifes ! Our broker said it was the fastest home sale shes ever done in 30 years of working haha.

:lol: wow that's awesome! I guess it really helps to know the seller. Congrats, that's pretty awesome!

We live really close to a military base down here and the housing situation sure doesn't look great. They're pretty old townhouses that backup ridiculously close to the highway... they might be nice inside but I'd be pretty surprised if they were.

Well so far I was put on hold which lasted 20 mins and I hung up because I have things to do today that are more important than being put on hold because " I am not in canada currently ".

I'm in the exact same situation. Emails and phone calls disregarded. My former address is still my parents house, and they've received nothing, so I'm going to have my folks just pop in and get it. Hopefully there's no issue in that.

Perhaps cite where it says that employers are obligated to send it before the last of the month to put the guilt on them?

I tried my mom has been in to the store twice for me and they tell her oh yes the manager needs to talk to the owner but she knows about it and it should be in the mail bla bla bla. Still no T4 and shes not returning my phone calls or messages I have left for her and the owner. This is so silly. We really need the tax return money too. Im tempted to just go in and file with 0 american income 0 canadian income and be done with it.

- International tax services canada already knows I have left canada, they have the date, I left a signd paper as well as my marriage certifiacate and copys of letters i sent to the GST requesting them not to send anymore gst checks.

She knows she is obligated, the employee that used to work there that I took the job from was quiting and never got her T4 either and was in the same battle im in now. I dont know if she ever got her T4 or not tho.

Have you contacted Revenue Canada and see what they have to say when a Company refuses to give one t4??

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

yep they put me on hold for 20 mins and I couldnt wait any longer because I had things to do. Im going to have to try to call again and hope to get someone else who is more interested in helping me. In which case I will post what happens. I was put on hold because I was not currently IN canada. Which I dont think is fair really.

As for now we are reshedualing our Tax Appointment ( i posted in the 2010 tax thread that I dont know what to do about my circumstances etc ).

I spoke with my sister and she said she will try calling my former employment tomorrow again and see if she can get any more headway than I am as when she checked the mail today nothing came again.
