Well the topic pretty much asks it. I am currently unemployed and am getting EI. I am struggling with the though of either looking for a job here which I know i will have to leave shortly there after or not having a job at all in canada. I have been unable to find information on jobs in the USA or what process can possibly be done (if at all). My husbands work may have a possible open position, that they may consider me for. however I'm wondering if there's a way for me to work for them while this CR-1 Process is pending (we just filed our I-130 on Thursday). If there is something that we can file for could someone explain this process and what all I'd have to do for it. Again even if this is possible.

I doubt it...you are not a citizen nor a landed resident and as far as I know..they cannot hire a foreigner unless thare are no residents capable of doing that job. You need your EAD documents as well as a SSN....

but I might be wrong

Just wanted to say that I was in the same quandary for awhile. I was laid off from my job last year (for very dubious reasons I'm STILL bitter about), and at the same time I had received my NOA2 and was starting the NVC process. It was a real toss up as to whether it would be better to get a job for a few months under false pretenses, or to go on EI and live on the cheap by temporarily moving in with my parents until the process was over. It was a VERY hard decision, and both options had serious drawbacks...but I ultimately decided that my integrity couldn't allow me to get a job then leave after three or four months. I still think it was the right decision.

It's always a tough netherworld when you're in that situation though...but ultimately, finding a way to stick it out until you can legally immigrate and garner legitimate employment stateside is your best bet. And like ZansGirl said, there's no "work waiver" you can get while you go through processing. If there was, dozens of us here would have jumped on it, I'm sure.

I don't see how you would be able to get any type of work permit or visa ie H1B etc. You don't qualify for any of the TN1 visas because those are non immgrant visa and you can't have any intent to immigrate but given your CR1 status, you are. You likely have to wait out the CR1 and either find short term work in Canada or ride out the EI claim. The core issue is under what authority would you be allowed to work in the USA and the answer is none, as far as I know.

You might be able to find work in Canada, especially short-term, as many companies (and government) are coming to the end of their fiscal year, so if they've got budget to blow, they might hire people to come in and get stuff done. Also look for short-term contracts, perhaps mat-leave fill-ins. You can try registering with an agency - they're generally leaders in contract work.

As for the US, nurture that contact for a future opportunity. :)

Temp agencies might be good for short term work, Retail might work out as well. Does it really matter if you're leaving in 6 months time? I wouldn't worry about how it looks to the company, it's none of their business.

I wouldn't divulge that you are leaving in 6 mons, companies will probably overlook you then

Thank you all for your replies. So it seems that there would be no way of doing this because any 'visas' that there are out there for this sort of thing has to have no ties to the 'immigration' process. If I'm understanding this correctly. Many thanks and I guess we'll see what the future holds for us.

All the best to all of you, Thanks again.

Think there is a few visa and status's that you won't qualify for, but I believe the H1-B is still an option as I think you are allowed intent with that visa. You might want to check into that one...

Really? Thank you for bringing this possibility to my attention. I will be sure to further research it and report back. My job would be in the field of IT support of some sort.

Thank you again.
