Hello all

I am a bit confused about when my husband can apply for his Citizenship On the 11th of march we will have been married 5 years!! He has had his 10 year green card since Feb of 08. I see alot of people getting there citizenship right after they lift there 2 year conditions. Am i misunderstanding this process, i thought you had to wait 3 years from the date on your green card? Please help if we can apply today for citizenship then i would love to do that since he is almost done with school and looking to get a job with the gov. (and of course you need to be a us citizen for most of them)

Three years (minus 90 days) from the RESIDENT SINCE date on your greencard

So it is 90 days i had a immigration officer tell me 6 months before the 3 years. Dang this sucks:( :(

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

what you are confused about is very simple. Most people apply for AOS immediately after marriage, so we end up with a 2 year GC. Once the two years are nearing the end, we have to apply for a 10 year GC. In your case, you applied for your spouse after you have been married for 2 years, so you didn't fall under that restriction and that's why we apply for lifting of conditions and you didn't need to. But you are correct, we all can apply 90 days from the 3rd year residency based on a marriage to a US citizen.

did your husband get 2 years conditional green card before the 10 years 1?if yes 3 years minus 90 days count from the date he got his first green card.

No one has received their USC right after they have lifted their two year conditions regardless of how long they have been married. With the marriage privilege, you have to be married, living together and paying taxes together for at least three years before you can apply. AND, must be a green card holder for three years minus the 90 days before you can send in your application.

If your husband received his green car in February 2008, he cannot apply until 90 days less than February 2011. You have already met the length of marriage time.

For history buffs, in 1927 our congress decided an immigrant is a better citizen that is married to a USC thereby granting a three year wait for USC rather than the full five years.

However this does come at a price, requiring a wheelbarrow full of documentation to both prove you are living and paying taxes and other bills together. If you wait for the full five years, can carry everything you need between two fingers.

My wife really amazed me as to how she took an instant interest in our political system, perhaps it's because she saw how her country changed from a democracy to a dictatorship in just a few short years. She already personally met our congressman and senator, I really don't feel her interest has anything to do with being married to me, but that is how our congress feels. A democracy can only succeed if all of it's citizens take an interest.
