I have a question about the M1 visa... I have found someone that I want to hire and bring them over to the US on a possible H1 visa... before I get my hopes up... once a person has recieved an M1 visa, studied,then returned home, and then the visa expired....( it has been expired for 1 year now) Can then an employer apply for a H1 for them? There was some clause that I read :

Can I change status from M-1 following the completion of my course of study?

Yes, you may apply for change of status to most other categories of nonimmigrant visas. However, you may not change to F status or H-1B status if the job offered is based on skills gained through studies while in M status.

would this just apply for while you were still on your M status? Or is this indefinetly? The M visa is no longer valid... so wouldnt it be like starting from scratch?
