Hey guys,

Ok, Im in the process of gathering all the paperwork, and filling them out. I have an issue with the I-134, affidavit of support. Now in one instance I heard that it doesnt need to be sent with the K-1 petition, that the sponser doesnt even need to be working when originaly filing. But that when the package is approved and further paperwork is required, this is where the I-134 comes into play. We know we need joint sponsers, but figured we had some time to gather that paperwork up ... but as I read through my checklist on the K1, it said to submit the I-134 with the I-129F. So which is it ? Does the I-134 need to go with the I-129 or does it go later ... also, I didnt see anything requiring when my police report would need to be submitted.

Aug. 10 - NOA2 Hardcopy received

Sept. 13 - Faxed off Package 3

Sept 14 - Interview notification set for Oct. 5

March 17 2011 POE Canadian/US border

April 1 2011 Marriage

Mailed AOS June 1

Chicago Lockbox confirms delivery June 3

Check cashed through bank - notification June 9

You are correct - the I-134 does not go with the I-129f petition (which is sent to USCIS). Instead, it will be needed for the Embassy/Consulate/Interview-stage. Same thing goes for the police certificate.

No, you are now filing the I-129F petition to USCIS for permission for your fiance(e) to request a K-1 Visa. Do NOT submit the I-134 at this time. No where does it say to submit the I-134 with the I-129F.

After the I-129F petition has been approved, it will move to NVC and then on to your fiance(e)'s Consulate. For the interview at the Consulate, you will need to submit one I-134 with supporting documentation for yourself and one I-134 with supporting documentation for your joint sponsor.

Supporting documentation might be one to three years tax transcripts from the IRS, paystubs from employers for the prvious six months, and a letter stating employment and current salary. Assets can be used in lieu of a joint sponsor or a short fall in the 125% of poverty level.

You will be asked for the i-134 in your p3 from the consulate. This is to be brought with you to the interview at the consuate along with your w2's tax returns etc.

Alright guys .... I have everything ... I have spent days going through mushy emails ...( do they really read them ? ) ... emails dating back 2 years now ... oh the memories :blush: I have printed and filled out everything I can ... tonight, while you are all eating dinner ... I will be surrounded by mounds of paper as I put the package together ... please think of me for I may get lost and never be seen again :wacko:

Tomorrow I will Fedex everything to my fiance in Texas and then it is in his hands ....

Yeah, you don't need the I-134 until the interview. When interview time comes around, exactly what you need for the I-134 can seem a little fuzzy. I figured it out this way:

-The I-864 is the affidavit of support used with immigrant visas. (You're going to do one of these for the AOS process).

-The I-134 is the affidavit of support used with non-immigrant visas (This is what the consulate suggests for a K-1).

-The K-1 fiancee visa is a weird combination of nonimmigrant and immigrant visa. It is technically a nonimmigrant visa, but one given with the understanding that you will become an intending immigrant later .

-The documentation required for the I-864 is a superset of the documentation required for the I-134. Which is to say that the I-864 requires basically everything you need for the I-134, and more.

So when you're putting together your "evidence of support" as requested for the interview (which you deliver personally, at the interview), make sure you have all of the documentation required by both the I-134 and the I-864.

What I brought to the interview was this: an I-134, with any evidence required by an I-134, and all of the evidence that would have been required as if I was bringing an I-864. It worked for me.

And this way, I was more than ready, when AOS time rolled around after my wedding, to quickly fill out the I-864, having gathered all of that evidence already.

You say they dont read them, but when you are beginning a relationship ... online ... the emails are all you have. I have read through them, and I have highlighted certain sentances. Like from his sister ... who told me what my fiances brother thought of me, what there dad thought when he met me ... so I have tried to find the I love you's over the course of 2 years, aswell as some from his sister .. saying things like ... he will make a great husband to you .... how else can you prove it when you only get to see the person a few times a year ... and Im a lucky one, Ive heard of others who havent seen there SO in over a year, i got 4 different times with mine last year ... your saying those 10 or so pictures of us together, or around his family is really all that matters ?

BlueBonnet, at this stage---sending the I-129F to USCIS---they are not yet looking at whether you have a bona fide relationship. That will come next, when your petition gets to the consulate and your fiance goes for the interview. All they need to see now (aside from the required forms) is proof of three things: (1) you (the petitioner) are a US citizen, (2) you are both legally free to marry, and (3) you have met in person at least one time in the 24 months before you file.

Some people send additional relationship evidence, others do not. We did include it, because we figured the whole package would be forwarded to the consulate. We sent a few emails (I think five) as well as a printout of the inbox from my hotmail account just to show that we regularly kept in contact even between visits. The emails we printed were ones where we talked about our dog missing him when he went home, planning upcoming trips, or common interests. At USCIS, they don't need to see evidence relationship at all. At the consulate, they really don't need to read the emails in detail (or at all), they just need to see that you did keep in touch in some way.

I should also say this varies considerably from consulate to consulate.
