My Fiancee overstayed in USA from 1986 to 1993 Would I face problems with immigration regarding his overstay? Any particular documents he has to show in the initial stages of filing the i-129F. Oh by the way, he never attempted to enter US after he left in 1993.

I am all ready to file I-129F for my fiance in India. Wanted to know what additional documents I need to send together with the form to show proofs that he has never attempted to come back to US for the past 17 years. And I would like to make sure that this process goes smoothly and he gets his visa Asap!

I have already filled out:

1. I-129F

a. Meeting in with in two year proofs: Pics, notarized affidavit from relatives, passport stamp, boarding pass, Flight itinery

b. 2 Intent to marry letter (his and mine)

c. Ongoing relationship proofs: emails, phone bills, letters we exchanged (not many because our high tech era

d. How me met letter (Notarized)

e. Naturalization Certificate (Notarized)

f. Mine and his Birth certificate (Notarized)

g. Our divorce certificate (Notarized)

2. 2 G-325A (his and mine)

WHAT ELSE DO I NEED THAT IS MISSING IN THIS PARTICULAR CASE OF MINE.

Thank you in advance

It appears your missing the check for the correct fee amount.

Photos for the G-325A are missing.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

Even if he had a 10 year bar as a result of his overstay, it looks like he has served it, so there should be no further consequences from that.

As I recall, the I-129F packet itself does not ask about the beneficiary's previous visits to the US, but when he goes to apply for the visa himself at his local consulate, once the petition you are preparing is approved, he will have to list all visits to the US. It is VITALLY important that he be completely honest and forthcoming about the overstay at that time. But I don't think it will be a problem, since it was so long ago and he has long since served out any bar that he might have incurred.

As for your packet, read the guides and the I-129F instructions very carefully. It certainly sounds like you have most of what you need, but it's always good to triple check the authoritative documentation.

Photos are missing but they have nothing to do with the G325a except that the instructions mention them consecutively. Passport style photos deserve their own line item in the cover letter as they are submitted in support of the petition, not the geographical form.

See the I-129F instructions, section six where items, A, B, and C are all quite distinct.

This confusion comes from old errors in the VJ guides that have since been corrected.
