I am going to file I-129F in a few weeks and should have more questions when I start filling out the papers. I know there is a section on the form that ask me to list any children she has. Well my question do I need any other forms to be fill out during the whole process vs. if she didn't have children?

Are the children coming with her? If so, the next stage of processing where the children are concerned will be during the visa application at the consulate stage. Even if they are not coming with her, they still need to be listed on the I-129F. How old are they?

Also check what documents she will need to satisfy the Australia consulate - every country can be different in their requirements - that she has permission from their biological father/ the family courts if there is no biological father on the scene to take them to the US for permanent relocation.

I personally wouldn't file the petition until I either had the required document in hand, or was 100% certain that I could get it in time for the interview.

Married: 17 July 2010

AOS mailed - Interview : 22 November 2010 - 10 March 2011

ROC mailed - approved: 14 February - 18 June 2013

NO, later for the forms for the interview there will more forms for the kids who will be coming along or will follow within a year.

Yes, her kids are coming along. They are under 18, so they don't have to file separate. She has a sign and notarize by their biological father. Should that be enough to show the kids can come with her?

Sure but remember you first "get them here" then you "keep them here" then you "keep them here longer". You'll be involved in three separate immigration processes for each of them. At each stage except for petition filing, each person has their own paperwork and associated fees.

She needs to get a Statutory Declaration signed and witnessed by a JP or Notary, stating "I hereby give permission for (your fiancee's full name) to take my children (childrens full names) to immigrate permanently in the United States Of America."

The Father will also need to provide a photocopy of photographic ID, that shows his address, which must be witnessed also by a JP or Notary.
