My fiancee and I seem to be running out of potential sponsors and the person who is our best option isn't working at the moment. She has more than enough in her bank account to cover the 125% over a 5 year period and it's not like she has a history of not working, she had held down a very good job for around two years but wanted a break to concentrate on college.

My question is will the fact that she's unemployed make a big difference if she has a more than enough funds in her bank account?

If she has enough assets that are easily liquidated (such as a savings account), and her assets easily reach the poverty level for both her household and the new immigrant, there should be no problems.

Instructions here: http://www.uscis.gov/files/form/i-864.pdf page 9 state that to use assets it must be FIVE TIMES, 125% of the poverty guidelines. SO for a 2 person household the 125% of the poverty guidelines is $18,212 so your fiance would need 5 times that amount for a grand total of $91,060 in the bank and/or in assets.

Have a good read of the instructions to make sure any assets she has can be used.

Good luck.

The number is three times, not five times for a spouse or fiancee but more is better.

Facts are cheap...knowing how to use them is precious...
