Hello,

My fiance is in the UK and received his visa friday. He was shocked to see his issue date 4 march 2010 and his expiration date 21 march 2010. On top of that he didn't realize that the envelope was not to be opened and opened it! He later realized when he noticed the big writing on the other side not to open it. He called to ask about why only given 2 weeks vs the reported 6 months for travel. They told him he would have to start all over if he didn't use the visa by the expiration date. At that time he still had not realized he was not to have opened the envelope. When he asked why only 2 weeks he was told that is all he qualified for!! What is that all about? He is SICK! How can they expect anyone make plans to leave their home in only 2 weeks time? Does anyone have any insight or suggestions? I will contact my senator tomorrow and my fiance has sent an email about what he needs to do about the accidental opening of the envelope.

Yeah that sounds very odd. I would also make an infopass appointment and it would also be a good idea for you to call the London embassy yourself. It will cost you some money, but this sounds like an appropriate situation in which to use the money. If you get some lackey, keep asking for a supervisor until you get some clear cut answers because you are supposed to get a stamp for 6 months for entry.

Because he was talking to the Scottish call center?

What difference would that make? He called the embassy in London from Scotland though as that is where he lives.

He was actaully approved in September but did not send it until March. They did not give us a reason until I got my senator involved and then they finally answered after ignoring several of our emails. We understood he had to wait until March but didn't realize at that time he would only be given a 2 week window to travel. He has been treated like a dog since his medical. He was approved at the interview pending the medical but had some difficulties with the medical. After some more testing they had him do which was a hardship financially and emotionally he was approved. All should've been done once his visa arrived but now after 15 months it is not looking good.

Wait, your interview date was back in September? That is six months ago...which makes more sense. Was your case put into "administrative processing" or "administrative review" (AP or AR)?

Please fill in your timeline (under your username) so we can better assist you; when was his medical finally approved?

Do not delay in getting ahold of your senator and talking to a supervisor at London!

Worst case scenario, can he just put his stuff in storage or leave it behind at his place and pay rent while he physicall goes to the U.S.? You can get married, apply for AOS right away and get your advance parole, which allows him to travel back to the UK without penalty, which takes about 2-3 months. It goes without saying that you don't want to have to re-file again (F)

The visa expires 6 months from date of medical in the circumstances you describe that is correct. He will have to arrange to take or send the envelope back to the Embassy to be resealed.

Are you saying that he didn't submit his passport until March '10, having received notice in November '09 that it was approved? Is the validity of the K1 visa from 2 November '09 then?

AOS is 'Adjustment of Status' which is the next step to getting his permanent resident status after marriage on the K1.

The visa expires 6 months from date of medical in the circumstances you describe that is correct. He will have to arrange to take or send the envelope back to the Embassy to be resealed.

He submitted his passport in november as soon as requested. They held on to it and did not respond to multiple emails we sent. When they did respond in January said new rules came out related to his physical he would have to wait until March to receive his visa. He has since then sent his torn package by mail after on phone all day being told to send it by courier which he already knew and tried to tell them again that he can not get courier service where he is. Now we are at the mercy of them as to whether they will send it back in time for him to travel. They would not allow him to go to embassy and have it sealed. I have again contacted my senator who will call them wednesday and see if they have received it and emplore them to return it asap. Time is ticking away and does not look good at all.

There is not any courier service available. It was sent by royal post. That is how he received the visa and how he sent the package pack with a special return mail envelope. And it is correct about the 6 months from the physical. It was wrong of them to hold on to his passport and also even if they had to do so should have at least informed him that his time ticking away. Even then how can you really make absolute plans without the actual visa in your possession? He is doing best he can. He asked again about possible extension and has been told that is not possible.
