Hi everyone ,

well I m here because I need your help, I have been married to my USC husband for 3 years now and over 2 years GC holder, the thing is we applied for ROC and we were just waiting for the decision. come to find out my husband is cheating on me right now and he told me he was, well now I dont know what to do, he doesnt care and he doesnt want me in his life and threatened to call immigration offices to stop the ROC processe, which I find rediculous since he was the one who cheated and now deciding to go with someone else, well I dont know what to do and I dont know what he will do I just need help figuring out my options ...

all advices will be greatly appriciated.

Take a deep breath, and try to relax. Wait until your emotions get a chance to level off, and your anger subsides. Once you and your husband can have a reasonable conversation, then you can decide which direction you want your relationship to take, independent of the immigration issues. Either way, if you entered into your marriage on a good faith basis, then you should be able to continue with the process and have a reasonable assurance of success.

Calm down, and then see what happens,

You are correct with one thing - even if he calls immigration they will not really do anything against you. He's the one who cheated and not you.

Lone Ranger's advice is excellent, although it is easier said than done. Try to follow it and just collect your feelings and thoughts. I am not sure how and what the process is for you since you ROC is pending.

When did you apply? and which service center?

You are correct with one thing - even if he calls immigration they will not really do anything against you. He's the one who cheated and not you.

It doesn't matter WHO cheats. At the end of the day it has no effect on your immigration process right now.

He is well within his rights to cancel the ROC petition but even if he does, this doesn't cancel your GC and mean that you're going to be deported. I'm not sure what the process is if you're changing from "joint filing" to "single filing" but I do believe you need to have evidence of divorce etc to file yourself (I can't be sure, that's just what I read).

I know you're angry and upset right now but before anything else happens you should start gathering evidence of your relationship. Like names on bank accounts, insurance policies etc before they change. You had a bonafide relationship and THAT'S what matters.

Also, the I-864 is still in play so he can't withdraw that financial support either.

We applied for ROC in June 09 to the CA service center. We received a request for evidence and replied to it in Sept. We called to inquire about it about a month ago, and were told it could take up to a year.

Every single response so far is fishy at best.

If you are about to separate from your husband, you need to withdraw the jointly filed I-751 before your husband does it and file on your own. You will receive an RFE for the missing divorce decree, which means you need to get busy immediately and file for a divorce. That's all I can submit right now as I'm typing on a tiny netbook.

Hello everybody, my friend, this is my comment. First off, in my own opinion, you committed a mistake of submitting your application for the first green card long time after you got married, you lasted about almost 1 year between your marriage and the application (you lost almost 1 year of time there in my personal opinion). Anyway, he cannot make too much for harming you at all. Why? your case is kind of advanced and even though that if he calls, it is not going to count too much at all. You have the green card already, if you were in the process before the first green card was approved, indeed there was a high risk there; many people do not know this, but if the person who is in the process before the first green card, it is just necessary only a letter (not a call, DO NOT TELL HIM THIS BIG DETAIL NEITHER) from the husband or spouse who is U.S. citizen telling or stating that he/she does not want to request a petition for you; thanks to God, that is NOT your case, because you have the green card, you are in the process now of removing conditions. Now, like we say in my country "try to extend out all the things more" or try to "touch him the ball" more; that is try to be very delicated and very nice with him, so in the worst of the cases you are going to handle and leave the time passes; anyway, if he wants the divorce right away, do not give him the divorce right away, do not sign him nothing, in case if he abandons you, you win the case, because of abandoning of marriage and you are going to have all the evidences handy of everything (please do not lose nothing and keep safe all the evidences of everything, even in case of a possible domestic violence or any report to the police is very important for future evidences). So, let's put the calculator ON, let's say that you need 3 to 5 monts more for your definitive green card or 10 year green card (putting a long term that maybe it would be less time in my opinion), let's say that he submitts the paperwork for the divorce in your state, at least is going to take at least 3 months talking in very fast terms(that is what is called "mutual agreement"); so, in case that he wants to submit a divorce paperwork, you only need to postpone that only 1 or 2 month more counting them from right now, and you are going to be safe. The divorce is not going to be done in at least 3 months and that putting the case if you want to sign the papers, it is possible that he wants to submitt the papers by himself and you don't sign nothing and the process is going to take at least 1 year (that is what is called not consent or not mutual agreement), so anyway you are winning the case, because when it goes up the decree of divorce, you have in your hand your 10 year green card. You are not officially divorced until the judge in your state writes down the official decree of divorce, before that big detail, you are still married, even though if you are separated you follow MARRIED. You only need to extend the things out with him at least 1 or 2 months and you are going to be very well; I recommend you that please do not sign him nothing in at least in 2 or 3 months to be nice with the time; hence, if he needs to submit whatever he wants, you just begin to "tease him or touch him the ball" and do not sign nothing, believe me, you are going to remmember my words and everything is going to be perfect, your vital key here is just 1 or 2 months more to hold him up, after that, he can do whatever he wants to do, even he wants to call or even he wants to submit the paperwork for divorce or abandon you, you still anyway win the case in front of USCIS, talking on the worst case, the normal or best case here is that you got the 10 year green card and the divorce is going to be later, that is the important factor. If you get divorced before decision on your case is made - you will have to notify USCIS and replace the original petition with a waiver petition.

Judging by your time line, decision could be made any minute now. If you provided good enough evidence, it will be a positive one.

Otherwise - Do Not Panic! Take care of yourself in the divorce proceedings, I am sorry this happened to you.

If you want to stay in the US, you should be able to, if you can provide good evidence that you had bona fide intentions in your marriage.

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1
