Hi

I have a question......I wish to go for interviews in the US, with a view to obtaining TN1 status.

I know in some circumstances interviews are disallowed...can anyone shed any light?

The situation as you've written it here is a bit vague.

--If you want to enter the US for a business related meeting, which an interview would qualify as, then you can enter as a B-1 visitor for business (or WB if using the Visa Waiver Program).

--If your prospective employer offers you a job then they will have to write an employment letter which you will bring to a POE along with your qualifications to perform the job that you'll be doing.

You cannot have "dual intent". Meaning, you cannot enter as a visitor for business and then adjust status to TN. Not sure if that is what you meant...like I said, your post was a little vague (to me anyway).

Bottom line, interviews are ok but you cannot go straight to work if they offer you a job because the first time you enter, you'll just be entering to do the interview (not the TN), you'll have to leave and then enter again as a TN.

You cannot adjust to a TN visa anyway, they are only granted at the POE.

Yes you can go to the US for interviews. What you can't do is go to the US as a visitor with other intentions.

Now, if I remember correctly you also are considering using your TN to adjust status by marriage to your boyfriend, which I'm pretty sure you can't do.

Good luck.

Thanks guys....I have decided for now, I am not ready to marry...so following my original goal of TN. Had some good news last night, a really nice Officer advised me to telephome the original officer who flagged me...to ask him to remove it...I had a long talk to the original officer last night and he promised to do what he can....I am optimistic my flagging will be lifted! :)
