First of all, my RFE is a two-page letter. The heading, layout and the first three paragraphs are exactly the same on two pages. Considering they sent me all the application receipts twice, I thought this is another duplicate mistake.

However, when taking a closer look, the contents of requested information on the two pages are different!! There are actually three items on page 1 and two items on page 2. Does everyone receive RFE like this? This looks very confusing to me! :wacko:

Ok, then for the evidence they request--

1. HOUSEHOLD MEMBER ON THE PETITIONER/SPONSOR'S FORM I-864 MUST SUBMIT THE FEDERAL INCOME TAX RETURN SUBMITTED TO THE IRS FOR THE MOST RECENT TAX YEAR... AND ALL SUPPORTING TAX DOCUMENTATION.

--the household member on my husband (the petitioner)'s I-864 is me (the applicant). Does that mean I have to submit my tax return and supporting documentation??? I only had a four-month paid internship last year. We are not using any of my income or asset on i-864. Why do they need my tax return?

2. THE JOINT SPONSOR ON FORM I-864 MUST SUBMIT ALL SUPPORTING TAX DOCUMENTATION (W-2s, 1099s, etc) SUBMITTED TO THE IRS FOR THE MOST RECENT TAX YEAR.

--the joint sponsor is my mother in law. We have already included her tax return documentations for 2006, 2007 and 2008. Why do they require her tax documentation again??

3. SUBMIT A COPY OF THE APPLICANT'S BIRTH CERTIFICATE

--My birth certificate is not in English. For the English version, can I just translate the document myself? Where can I go to certify the translation?

Regardless of income, a sponsor must submit supporting documents with the I-864 (so they'll need your tax return(s) and any supporting documents such as W-2's 1099's etc).

For USCIS, you may translate it yourself.

2. Best best is to apply for an IRS tax transcript for each year. They're free and take about a week to arrive. If you don't want to do that, make sure the schedules are also included with the tax returns.

If you are the US citizen spouse - you are the sponsor. Either they are missing supporting evidence from you (yes, whether or not you earn sufficient income) or perhaps you completed the form incorrectly.

Apparently they either didn't get all your co-sponsor's supporting evidence, it was misplaced, or we're missing something here.

Silly questions:

  • Did you and your co-sponsor both compete I-864 forms (one from each of you)?
  • Do you and your husband live with your mother in law

It should go something like this:

Sponsor (You)

*I-864

*Supporting evidence (Tax return(s), and all supporting evidence you sent the IRS with those returns)

Co-sponsor (mother in-law)

*I-864

*Supporting evidence (Tax return(s), and all supporting evidence you sent the IRS with those returns)

*Proof of citizenship or LPR status

If any assets, stock/bonds, bank accounts etc are used, you must include documentation/supporting-evidence to back it up.

Silly questions:
  • Did you and your co-sponsor both compete I-864 forms (one from each of you)? --The sponsor completes I-864 and the joint-sponsor a separate I-864.
  • Do you and your husband live with your mother in law --we don't. but the mailing address is the same. Does that matter?

It should go something like this:--It is not asking for the sponsor's tax documents, but the tax document of "the household member on the sponsor's I-864". So i am very very confused right now.

*Supporting evidence (Tax return(s), and all supporting evidence you sent the IRS with those returns)

Co-sponsor (mother in-law)

*I-864

*Supporting evidence (Tax return(s), and all supporting evidence you sent the IRS with those returns)

If any assets, stock/bonds, bank accounts etc are used, you must include documentation/supporting-evidence to back it up.
