my husband and i were separated for 8 months and we were thinking about divorce.. i actually filed for it.. but we never went through with it... we are back together and are very happy but have this dark cloud of uncertainty over us..

so will immigration look on us in a different light or magnifying glass if you will now.. so really we will only have 2009 tax return.. there is a gap in the bills because of the separation.. like i said we are unsure what to do.. i don't want his case denied due to our stupidity... please help us if you can with your comments.. we also appreciate prayer.. thanks

There have been much worse experiences shared here that resulted in positive results.

Honesty is key here. You need to apply for the I-751 jointly, and then you might want to include a short letter explaining the separation period. You can also explain that it was a difficult time and you worked it out and are happily back together. As long as your evidence supports what you claim and that you are really in a good-faith marriage, then you should be ok. Worst case, you will get an interview letter and both of you should appear and show that you are happy in your marriage and provide with any answers they IO might be looking for.

In your case, emphasis your evidence on the beginning of your relationship and now.
