Can I apply for IR-1 for my wife immediately after marriage?

I mean, according to the rules I can.. but does it hurt my chances?

Because the I-130 form asks how long we've been married and the address we've lived together... I'm planning to apply immediately after marriage to save time... so what can I answer in this part??

Secondly, they want not only the marriage certificate but also proof of a bona fide and ongoing marriage. I can get someone to say we're married, but it won't be ongoing for very long when I apply. So what can I do???

We filed 8 days after our wedding. But it is the CR-I not the IR-I because for that you have to be married for two years.

We added a lot of proof for a good realtionship before our wedding, affidavits of relatives and we got a joint account in the States and Germany which was no problem at all.

You don't have to wait to file!

Good luck!

It may help you to get familiar with the CR1/IR1 guides on this site. The guides will give you a good overview of what you need to file etc. As Antje/Terry pointed out, you can file immediately and that you are filing for a CR 1 (conditional residency) because you will have been married less than two years. It would be an IR if you were married more than two years. Nothing is stopping you from filing immediately. Your spouse cannot live with you in the USA while you await the final approval of the CR1 visa.

Proof of a bonafide marriage includes your marriage certificate proving that your are legally married; evidence of an ongoing relationship such as pictures of you two together and with other family members etc; boarding passes/travel itineraries from visits; telephone and email logs, letters from friends or relatives; joint bank accounts etc. Those are examples. Your 'chances' with respect to filing the I 130 petition is not at all affected by how long you've been married. You can marry and file the next day if you want.

Again I would suggest you read and become familiar with the guides.

Good luck.

I would also check out how long it will take for you to get your marriage certificate. In Canada we had to wait 12 weeks after our marriage to apply for our marriage certificate (this time was just to ensure everything had been properly filed in Ontario). This is also something you should check out. Remember the certificate is different from the license. Just something to keep in mind in case where you live has the same stipulations.

No, you cannot ever apply for any visa for your wife. You can file an I-130 petition for her, which when approved will allow her to apply for CR1 visa. IR1 is for people who have been married two years or more. The common practice is to file the petition as soon after marriage as possible, so you can be together in the USA. Expect a 5 to 8 month process from petition filing to visa interview.

Start by studying the appropriate "Guide". Just click on the Guides link at the top of any page here.
