My fiance plans to visit me in US in a month time. When he is here, we plan to work on the I-129 and prepare whatever documents that are required together. We think it will be easier to work and discuss on the application together and face to face. What we are not sure is whether it's ok to send/submit the I-129 while my fiance is in the US? Or is it better to send the package after he leaves???

Any opinion is highly appreciated.

Sure but make sure you file an I-129F, not an I-129. Not the same thing at all.

We filed when I was in the US with my fiance, and we were both glad we waited until we were together to do so. It gets difficult sorting everything out by yourself, and as was said, it's so much easier for signatures, photos, etc.

The only section you should pay close attention to is where you can state that the beneficiary is indeed in the US upon filing. It's on the I-129F somewhere, and although our package was actually mailed after I returned to Canada, we still stated I was in the US upon filing, so I'm still not 100% on that part.

But yes, I'd almost recommend filing together with your fiance. It's a neat feeling to see all the evidence fall into place, and you have another set of eyes to look for errors, things you've missed, etc.

My Fiance and I put our paperwork together while I was in the U.S. It is so much easier to get everything together with all the supported help. I had left before the package was sent out and we did not state I was in the U.S. because I was already back in Canada when we filed, but from the sounds of it, it seems like it wouldn't have been a bad idea to state so in the forms. We did send in my plane tickets and supported evidence of me being there at that time though.

Yeah, I read over the the guidelines and although we thought I would be in the US upon filing and sending, it took us a bit longer to get everything together, and she ended up mailing it two days after I returned to Canada.. I hope that's not going to be an issue, but we will see. Leave it to these long wait times bringing up more things to worry about :P
