I am holding a 2 year Green card, which will expire in July 2010. However, my marriage didn't go well. We have been living separated for a couple months. Now, we are thinking about getting divorce. I am in CA, so it takes 6 months for the divorce to be final. But, my green card will expire before that. What options do I have?

Did anyone surrender the green card before? I am going to school now. In may, when school is over, can I surrender the green card, then going back to my country and get a student visa to come back? Is this possible? Can I go back to my country when the divorce is in process? Do I have to be outside US for certain time before I get interview for the student visa?

I'm sorry, your marrige didn't work ,

any decision you'll make will be right, but I would go to uscis.gov first and check, they have explanations what to do in your situation, it might take longer and you might even hire a lower, make sure lower is good

any way going back home will be more stress and more expansive, than to proceed with the case you have

Sorry about your situation , but you can still file the removal of conditions using a waiver , you can explain that you entered the marriage in good faith but it did not work out , i wish you all the best

I agree with NYC guy. Plus if you and your soon to be ex are in friendly terms maybe he will be okay with you staying here and you can file for the 10year green card.

@ Nycguy78: Looking at the bona fide list, I don't have a lot of document proving. We only have joint tax return ( 2 yrs), bank statements, club cards, some pictures ( he is not photogenic), credit cards.

We both can't afford health insurance therefore we don't have health insurance, life insurance. The ultility bill is only in his name.

I have my school mails and student loan to the current address. Should this be submitted in?

I have a lot of emails we exchanged when we were dating. Should I submit this in?

You should submit every piece of paper that you have , Emails are a good idea because it will show that the relationship progressed well and the marriage was entered in good faith

Do not go back to your country and apply for student visa. It will be more expansive and difficult to get (Plus, American schools for international students are waaay too expansive).

Just file for ROC yourself. Since you have proofs that you entered the marriage in a good faith, you should be good to go.

Get a lawyer and file for divorce.

Hello everybody, my friend, I think in your case is not problem at all. Firt off, remmember that you need to fill for the remove of conditions 90 days before your 2 year gren card expires; I think that you don't have any problem and you have all your evidences that your marriage was real and please anyway keep up all your evidences of everything, do not lose nothing; you can apply to the check box of divorce in the petition, you are not going to have any problem in my opinion.
