There are special rules for people who are unlawfully present over 180 days, but less than 365 and are granted Voluntary Departure.

03/03/2007 - Flight out to States

12/21/2007 - Wedding!

02/27/2008 - l-485 sent

04/29/2008 - AOS Biometric

05/01/2008 - I-94 Expired

07/22/2008 - AOS denied

10/28/2008 - In removal proceeding

01/14/2009 - Flew back to Brazil ;(

02/10/2009 - Hubby flew to Brazil ;)

IR1 timeline

09/23/2008 - I-130 sent

11/06/2009 - Interview in Rio de Janeiro - CO need an Advisory Opinion (sent an email to DHS with my I-94 and court order)

12/02/2010 - Hubby went back to the U.S.A ;(

The time amount for a ban is more severe if the overstay is over 180 days... do a search of overstay on this site and there is a lot of info on the penalty times and waivers

11-30-09: GOT GREEN CARD in mail!!!!!!

Citizenship Process;

1/11/2013: Mailed N400 to Dallas Texas

3/11/2013: interview.. Approved

4/4/2013. : Oath! Now a U.S. citizen!

I think ovestays over 180 days and under 365 days where the person wasn't deported is a 3-5 year ban, as opposed to a 10 year one.

If granted voluntary departure I believe an I212 is not necessary as it is for deportations or removals. The ban will still remain if unlawfully present for over 180 days which is a 3 year ban.
